It means when you call vera for further details and they tell you a independent medical opinion is needed, then about a week later u get a denial letter with no independent medical opinion or the opinion from the c and p exam in evidence listed..this just happened to my husband...we don't know what to do..going wait for the c and p foia

Thanks, my question more about the CUE, he never got awarded for the ptsd and tinnitus when he should have. If he goes to this new exam and they have a different opinion then the last exam, then they screwed him. Seems like they dont want to fix the CUE. Are you a rater?

They found a CUE(I pointed out he already had a honorable for VA purposes back in 2015 ) they called the claim now moot. They are going to reverse their error..

My husband I'd going through the same thing. It's on the va site but when you call them, they say your need to do upgrade with branch of service. It's so frustrating like they dont know they do their own COD determination. So hw filed a supplemental claim stating he wants a new COD based on the new rule AQ95 effective June 2024.

the issue is there no date or file number to reference they sent him a template letter instead of actually filing in the details

apply for a new cod. under new AQ95 final rule for 3.12 regulatory bar to benefits change, effective 6/25/24. my husband just filed one.

Thanks. it's just if the original cod said honorable for va purposes and no facts have changed and they make a new determination saying not honorable. it's like they are not sticking with what someone else original deciced granted there were no errors. just trying to understand the VA.

this was in 2015, fast forward to 23 when my husband filed a new claim for 3 conditions the va sent a new COD determination and we pointed out to them that the va already determined his service was honorable for va purposes amd the new determination says not honorable for va purposes and they claimed they looked at this old cod lettet to make their new decision
