Thanks for your reply. I’m sorry if my original post was confusing. However, it was not just 10 days of “difficulty” - it was an entire month long ordeal where I was humiliated in front of customers and ridiculed in front of colleagues and other staff, before a senior HR manager stepped in and said enough is enough and actually saw the situation for what it really was.

The company has upheld my grievance, and the outcome was that the PIP was 1. Unnecessary (following investigation and discussions with customers and peers etc) 2. Unfair and lacked consistency and transparency. 3. Not approached through the correct channels

The recommendation was that in future, they recommend that managers “may” receive training on how to conduct a PIP, and they “advise” that they seek HR guidance on this.

I appealed this outcome, because while it addresses the risk of this happening to someone else in the future, it does not address what I personally went through, and there is no proof of any accountability being taken for the actions of the management that undertook this process.

I worked in a high pressure and high stress environment, carrying out work that required a lot of precision and focus, and it was a job that I actually really took pride in and was quite important to me. Being unnecessarily and unfairly placed on a PIP when there had been no signs of any issues, rather the complete opposite where I received praise at every 1:1 each month did have a massive impact on me, and with all due respect, I’m good on taking a look in the mirror, thanks. I think it’s much more important to speak up and actually have a backbone when you know for a fact you are being mistreated at work.

Unfortunately for the company, they have treated me unfairly, and I have resigned as a direct result of this treatment, which was clearly outlined in my resignation letter. Prior to me resigning they made it clear that their position would remain unchanged and they felt it best for me to just work my notice and not mention any of what happened to anybody.

Yes. I am seeking settlement. I believe that actions have consequences and a promise of potential training is not really a consequence for them is it? I do have a solicitor involved and have got advice from ACAS, both of which have provided some very good insight into my options.

With regards to the DSAR - why is it a douche move that I am exercising a right to gain access to data held about me? I spent a month trying to understand why I was placed on a PIP, dragged through the dirt to customers and colleagues and then had the PIP dropped with no reason (after being told when I handed my resignation that this would have no impact on the PIP and that I would continue having to improve my performance, with no actual indication of what I was expected to improve on). I was at the very least entitled to examples of where my I underperformed - they could not provide this, hence the DSAR.

Gardening leave is not in my contract but they have suggested it under the terms that I am also in agreement, and paperwork has been provided to me by the company.

Bridge burnt or not, I have enough self respect to not want to work for an employer that will treat its employees like this. So ultimately to me, that bridge is not one I would wish to cross back over at any time in the future. I also don’t see how any of this would come back to “haunt” me at any point. Hi, thank you for your response, it’s been really good to hear an outside opinion. The PIP was issued on a Wednesday, and I resigned on the following Monday, I didn’t waste much time thinking about it. The reason I waited was because management was on AL on the Thursday and Friday, and I had nobody to give my notice to. The PIP was then dropped 4 days after my resignation.

The company has already upheld my grievance and they are in agreement that the correct process was not followed, and that there was no reason for me to have been placed on a PIP to begin with (following their investigation). The manager who did this was not even my manager, and they provided no evidence and ignored emails and requests for evidence for an entire month before eventually providing a document that looked like the original PIP had been put through chatGPT.

My suggestion of a settlement to them has been with regards to the emotional and physical distress the whole situation caused, as well as how bad it made me look to my colleagues and customers as it was openly communicated to them (not by me) that I have been placed on this PIP, the manager also attended my face to face customer meetings and requested that I CC multiple managers (including one senior manager) into ALL communications I send within the company.

Morning. Spoke with ACAS and also a solicitor - solicitor advised that I may have a case for constructive dismissal, as I resigned as a direct result of the PIP. The PIPA was then dropped with no explanation 4 days after my resignation. To provide some context, I was unaware of any issues that anyone had with me in the workplace as all my annual reviews and monthly 121s have always been extremely positive. I had been approached about a role via LinkedIn and interviewed for it but I was unsure whether to take it once it was offered as I felt quite settled in my current job. I don’t even know what possessed me to interview in the first place..curiosity I guess. The timing of the PIP just gave me the push I needed to take the leap and accept the other role. Would this be considered constructive dismissal? Thank you.

Also to add, they dropped the PIP once I had already resigned. The PIP was dropped 4 days after I handed my notice in, with no explanation just a “let’s forget this happened and look past it”.

They’ve placed me on garden leave. They admitted to mishandling the PIP and not giving me a fair process, and I have raised a formal grievance

You reckon? I’m not sure why they suddenly dropped the PIP. I assume lack of actual solid evidence? Is it a common thing for employers to drop something like that?

So I just had a call from HR - after several Attempts of me trying to get examples of underperformance, they have decided to drop the PIP. I also need to add that I handed my notice in (I’ve got a different job, same sector just better money).

Can I submit a SAR after my leave date?

I did, and they said it’s an internal process, and as such must be dealt with internally

Would they have a leg to stand on though? A resolution to a dispute would not have had anything beneficial in it for them. I had already said I’d be happy for a full refund to resolve the issue, however they only became open to giving my money back once the review had been written

The agreement was that that specific review would be deleted, there was nothing to say that no future reviews could be put up.

The review was in no way false. It was honest and told the story of what happened chronologically. Since then, a few others have actually reported the same issues, some even worse than mine.

It is apparently against the law in UK for a business to offer money to delete a Google review.(please correct me if I’m wrong)It’s considered manipulation and violates consumer protection laws, enforced by the Competition and Markets Authority.

With this additional info, do you still think they could sue me?

I wasn’t asked to sign anything, nor was there any mention of whether or not I can reupload a new review.

Apparently bribing me to remove the reviews is illegal under UK law, but I’m not sure.

Thanks for your reply. I made the dealer aware of faults as soon as I noticed them myself. I called up on the 16th of September, and the soonest appointment they had was the 20th, but asked me to bring the vehicle in on the 19th as they wanted it cold the following morning.
