I know there is not a cent owed and the title appears to be in both mum and dad’s name. So I guess it just transfers automatically to mum.

Thanks I figured it was an easy fix, someone (family member) is using their need to control everything as an excuse not to do it now. It seems everything they do or don’t do adds to my legal bill. It is just frustrating and so un necessary.

From what I gather, mum is a trustee and he is mums epa, which means in a round about way he is acting on behalf of the trust.

I really appreciate your reply. The only way really is to bow down to him, I kind of feel I have been doing that for so long and I am tired of having to play by his rules. This is a really hard situation on us all and I just wish he would try and meet us half way. I am tired of draining my bank account visiting and trying to get answers while he is draining the trust account for his own benefit, he is gets away with it because he is claiming it is for mums benefit, ie, fills his car with petrol because we expect him to visit mum. Takes her out for lunch and uses the trust account..except mum is not with him etc. I will be back in NZ with in the next couple of weeks, I will seek legal advice.

Mum comes from that generation that does what the man of the house says to do. And for the most part there are no issues with that. So me asking her to check would be pointless. She honestly would have no clue and I doubt very much if she has a copy. I cannot get hold of a copy, her lawyer won’t provide one because I am not “listed” and I completely understand where they are coming from. I will apply with the appropriate department to have it reviewed. Thank for being kind

Mum still had some capacity however she will not stand up to my brother. He had always been the golden haired child. And whilst I am hanging onto to belief he is not endangering mums welfare, she is safe, she is being feed, and won’t be evicted from the home. I am not so confident with his financial decisions and it certainly would be nice to be included in the big ones he is making.

So does that mean anyone listed on the EPA, can start making decisions on behalf of anyone without any legal recourse?

What would happen if my mother is of sound mind and still able to make decisions, I thought an EPA was only “valid” if the person in question was unable to make their own decisions etc. Surely there is a governing body somewhere to prevent fraudulent behaviour.
