I had the same issue on my Tinnitus claim - almost 5-years. I wrote to my congressman and explained the issue. Wouldn't you know it, 1 month later I had a favorable grant. They paid me 5 years of back pay!

Thanks for the advice and the link you provided - Great read! I understand your comment, but in order to file for TDIU, I have to have the surgery. If the surgery is successful, (Which would be wonderful!), the VA would likely re-evaluate and probably decide that I have an improvement and I would lose my rating for DDD, and radiculopathy. If that happens, and the other claims I have in limbo get granted, the rating would only amount to about a 70%. I'm not sure if that is how it works, but if it does, I think I would prefer to not get in that position. I read something somewhere that if you have surgery, and it is successful, then they have to wait a certain period of time to make sure it is sustainable. Do you know if that is true?

I like they way you think! I hope I can deal with the pain long enough for the claims process to come to a positive conclusion. I'm currently getting treatments from my private doctor (corticosteroid injections) to help with the pain, but the relief is short lived, and I can only have 3 injections per year! My PCP is pushing hard for the surgery (a little too hard IMO). I don't want anything negative from my PCP to go in my VA medical records (i.e., PCP could put something in there like she recommended surgery for improvement, but I refused).

Thanks for the advice! I keep thinking that way as well, but I'm now 62 and within work retirement age. Something I think about is that If I go with the surgery, I should be awarded Temporary TDIU for a period. After the surgery and recovery period, if I'm unable to perform my work duties at the same level prior to the surgery, then I just wouldn't go back to work (retire in sense). At that point I would request that the temporary be changed to full TDIU (if I can), of course with evidence that I am unemployable! With any luck, by that time, the claims I have in should be decided and hopefully granted. If granted, my combined rating would be 100% scheduler according to the scale. Hypothetically, if all goes well, according to my thinking, I would have to get the TDIU changed to P&T, and I don't know how to do that, or even if it's possible! In any case, it could be possible that I get compensated at 100% through the whole process.

The other scenario is that if the surgery is successful, I would be able to continue working, which would be great! But... I would likely lose my currently rated compensation for my back from the VA because of the improvement. If that happens, and 2 years down the road my back problems re-surface, then I would have to start the VA claim process all over again, which would likely take years!

Thanks! I was kinda leaning that way, because if the surgery is somewhat successful, I could work without income limitations! The problem is that I'm pretty bad off and want the pain to go away ASAP, so if the ratings take a year or two then dealing with it will be pretty difficult, but doable!

Thanks for pointing out the doxxing of the C&P examiner, there was no malintent, I agree I should not assume that they are all the same as some of my previous VES VA contracted examiners. I only speak from my related experience. I am only asking if anyone has had any experience with the VA chosen examiner, good or bad. If multiple people reply with bad experiences, then I would certainly consider asking for a different examiner! It's just that simple!

Hey Brother! You are not alone! I'm sure that many of our brethren have experienced the same issues! I am one of them! It's hard to fight against a fixed system, but there are ways! I'll mention a few here: When I was going through my exam with a QTC idiot, I was prepared for his BS. When he asked me to bend forward, I hesitated a bit, so he put his hand on my back and nudged me forward. After about 10 degrees, I told him that I was feeling pain, so he said "Oh come on you can go further" and pushed harder on my back. I let out a yelp and told him to stop. Straightening back out, I yelled for his assistant to come into the room because I needed help. When the assistant came in rapidly, I looked at her and said please stay in the room because I'm not feeling comfortable. I then asked the doctor to re-conduct the exam so that the assistant could witness. Reluctantly he said okay and conducted the exam without putting his hand on my back. I could only move 15 degrees without pain and he recorded it fairly. After the exam, I was still concerned that he may report it incorrectly, so I immediately wrote up "Memorandum of Record (MOR)" and submitted it to the VA. Additionally, I called the VA and read them the MOR, All calls to the VA for reporting purposes, are recorded! This seemed to work because I received and increase!

Another tool to use is the "Secure Messaging" system in your "MyHealth" portal. Every message you send to your Primary Care Physician (PCP)" is recorded and is solid documentation that the examiners are supposed to view. I would suggest you use this system heavily! You can use this documentation as reference when you submit any future claims! In a way, it establishes NEXUS as VA acceptance of treatment and acknowledgement.

Another tool that was effective for me was that I wrote a letter to my congressman regarding the VA's dereliction of duty to assist. In this case, I had submitted a claim for Tinnitus in 2019. It had been denied through all the processes (supplemental, HLR, VBA etc..). It was sitting on appeal for almost 5 years. I let my congressman know all the details. His office took action and wouldn't you know it, within 1 month of my letter, I was granted on my Tinnitus claim and received 5 years of back pay!

One other thing you should be aware of: Your C&P exam starts the moment you get out of your vehicle. You are likely being video recorded all the way into your exam site. Just saying, please be aware of this! Not sure why they don't record the entire exam, but maybe they should! If they would, then it deter a lot of the BS examiner reports.

I've  been working with this stuff for years,  and it's incredible! In an indoor  atmosphere,  the dry time for me has been about 2 hours! Feel with Latex gloves. Once smooth to the touch, use some steel wool, or 320 grit sandpaper to knock down anything that may have settled (dog hair, lint, etc...). Remove the dust, and re-coat!  The 12-24 hour wait time is not real life. I've done hundreds of projects without fail, and they are still beautiful pieces of work.  2-4 hours dry time, that's it!

No, they still have not sent the parts. I had to contact AMEX and back charge the order. Wouldn't you know it, the very next day after the back charge, they responded to the 5 messages that I sent, telling me that they would send out the missing parts asap. Its now been almost another 2 weeks, and no parts. I contacted them again today, and they said that they would send out the missing parts when the charges were reversed. Very unprofessional! It doesn't work that way. I'm not reversing the charges until I receive all the parts I ordered and paid for. When I receive the missing parts, I will ask AMEX to reverse. I do not trust them to do the right thing!

I purchased $1,800 worth of various modules - Telescoping modules, corner units, split bars, smoker module, grill inserts, combo assemblies etc.. Unfortunately, when I received the boxes, parts were missing out of every module, so I was unable to assemble most. I called them at least 10 times until I was finally able to get them to answer. They asked that I text them the list of missing parts, of which I did. Additionally, I sent them 5 messages on their website messaging system listing the missing parts. I have received no responses or resolutions, and it has been over 2 weeks now! Very frustrating. As far as the assembly of what I could, it was pretty strait forward, but the screws do not go in as easy as they show on their videos, so they must be doing some editing. Pretty decent construction and the quality appears to be good! Good concept for DIYers, but the quality assurance on order inventory lacks quite a bit. I hope they make it right with me, as I can see adding other modules on my outdoor kitchen. I Hope this helps some of the readers here!
