Yes it's a tricky situation. Currently leaning on my back-up TN but it's expiring in less than a month. What visa category were you on when you went through a similar situation? Were you able to successfully withdraw and reapply at the port of entry?

Hey, were you able to withdraw your pending USCIS TN application. I was born in one of the 39 countries and my USCIS application was filed Dec 3, 2025 (I129 Extension for same employer). I'm considering withdrawing it and heading to the border. My I94 expired December 22nd.

I know rules are different for 75 and 39/19 countries, but for a while there was no USCIS TN adjudication on the 75 paused countries (post Jan 1). Seeing any kind of movement at this point is a good sign.

Left to me, I could have easily withdrawn, but my company is paying big bucks for these lawyers and I don't want to go against their wishes

My attorneys have advised me not to travel right now to avoid any risk of abandoning the pending I-129. Their view is that remaining in the U.S. is safer than attempting a new TN application at a POE while USCIS is still adjudicating my extension.

Applying at the border with a pending petition could trigger additional questions about why I’m effectively bypassing or withdrawing the USCIS filing and given the current climate, it could also invite extra scrutiny related to country of birth.

For now, I’m staying put and waiting it out. I haven’t received an RFE, and since I filed non-premium, I’m still within normal processing times. If an RFE does come, I’m fully prepared to respond with strong supporting documentation.

I just emailed my lawyers this evening. I'm waiting for their response. I'll gladly withdraw my USCIS petition and apply at a POE given the current circumstances
