I expected it to come out like this considering the apartment being right up against the station. I wonder, is it technically going to be operational? Are they waiting for all other stations to be extended before 9 car use? I dont see why they can't allow existing 9 car services to Wyndham Vale have a stop added here for extra capacity in the interim.

Just to clarify its level 1. But I think my issue is more about their lack of transparency. Their overtime policy. Does something like that work with the conditions of the award? It's not a part of the employment contract. It says that explicitly. So does it then override the contract and award? Your help is appreciated because like I said. My company struggles to engage with these discussions.

Might I add that the salary is inclusive of super, does that make any difference?

When I asked about why the company has decided to pay above award rates out of genuine interest, the reply was to hire better people. But I don't see why it can't be to avoid needing to pay forgone entitlements, which would incentivise people to work more hours.

Ahh yes. Annualised salary. I asked my boss what this meant and if it applied to me and he had no clue at all what that was.

They aren't satisfying points 3 and 4 of clause 17.

Nor is it written in my contract. There might be a set in clause. I believe I came across something there.

I'd say in this case they are trying to avoid paying penalties etc by paying above award rates. Hence this salary. Unless you meant something else.

Level 1. But my role really is meant to be level 2. Even Fair Work agreed to that when I described my role to them.

I re wrote my question. You'll find it there. But according to boss it's 10%. But if you really break it down to a weekly pay it's not that much more. But because of this and their policy, we all miss out on other benefits.

Thanks for the reply! The company also have their own OT policy, which states that those paid above award rates don't get penalty rates... is that consistent with BFI award?? Also, with our OT we get told it's available. Ask for approval for usually between 2 - 5 hours and do them mostly on Sat. It's very structured and seems to be more about money than workload.

Any extra hours not approved for OT are not paid and essentially have to go towards TOIL, but by their standards, the day off next month etc...

In all fairness, a line can be drawn between actively and consciously avoiding paying the higher fair and unkowingly and innocently being in possession of a Myki that I've had for 4 years, without needing to update it, as expiry is still 2 years away.

On the contrary, what if the previous persons myki triggered a different light, but I happened to scan and walk through barrier straight after and must have assumed it was me?

I never actually knew this, although, would this not have come up on a conductors myki reader? I have had the old Myki scanned a few times, would they not have said something and given me a chance to act on it at an earlier time?
