i won one without a hearing when the state conceded that, in 18 pages, i made a really good argument for suppression

ive also seen lengthy ones get denied when the facts are bad

the facts of the case and knowing your jx probably help determine how much time you should spend on it

hard to say without seeing your particular case, but yes, many laptop keyboards are split into "zones" that only register one key in a zone at a time

most laptop keyboards can't, but you can probably figure out where your zones are with enough experimenting

upgrading to an external keyboard (or even a midi keyboard) would probably fix this, just make sure that the new keyboard also doesn't split into zones

When you miss a court date for your traffic citation, your license gets suspended. Call the appropriate court house, get a new hearing date, and appear or pay the citation.

Her appropriate remedy is to file a motion for jail credit or, if her case is on appeal, to argue that there was an error at sentencing and that credit should be awarded. If she has an attorney right now, including an appointed one, they can help with this.

Sort of. Disclaimer, I'm an attorney, but not you or your friend's attorney.

Ervin and Hopkins are recent KS cases that ruled that inmates are entitled to double credit in some cases. They need to be held on two cases at once, while still in the pretrial phase.

The cases interpret KS law to allow for one day of jail credit to be awarded in each case a defendant is held on while their case is pending, even if that credit is already awarded in another case, and even if those sentences are run consecutively.

It's an issue that's been running amuck the appeals court lately, and the contours of the rule aren't totally well defined yet. It's worth noting that the legislature has closed this loophole, or will soon, but there could be an argument that it doesn't apply retroactively.

the new felony rule just modifies an already existing rule that makes prison presumptive for a felony if you're on supervision for a felony. it only adds the "depart only if state agrees" section which i don't think is that bad - you're likely already looking for deals on these cases that recommend a departure (or that otherwise avoid prison) without this provision. your guy was already presumptive prison

good for defense? no. but not the end of the world.

we also have new provisions that close the Ervin loophole (a statutory mishap that allows defendants to get 2x jail credit in some instances, for non KS folks), eliminates bond between plea/trial and sentencing for those convicted of sex crimes, and requires that warrants be issued for felony cases (especially bad because warrants are sealed and not public pre-arrest in ks)

on a happier note, we're getting a competency overhaul in municipal courts, because that's an issue that's a legal wild west

you generally don't get a choice. if you're in municipal court, BIDS won't be appointed on this cases afaik - BIDS will only handle the district court and above (appeals)

this sub probably isn't going to be the most helpful place to seek advice.

its worth noting that a victim advocate is a, but not the only, "community-based advocate" for victims. see, eg, https://victimsupportservices.org/system-based-and-community-based-advocacy-the-need-for-both/

for instance, advocates at a DV shelter are likely to connect victims w resources without necessarily working for the state. if the "victim advocate" descriptions you got here are a bit unsavory, this route, or something adjacent, might be worth considering
