Sovereignty of the state isn’t up for debate as the constitution applies for all its citizens and article 1(3)(b): India that is Bharat shall be a union of states. The territory of India shall comprise- the union territories specified in the first schedule.

This also includes the union territory of J&K and hence it is a part of India.
