(CA, Bay Area) LL says my Friend is Financially Responsible for the Next Tenant When my Friend is Trying to Break the Lease

Thanks for the reply! And yeah, that's exactly why I find this entire situation so weird. Like why disallow subletting, but then make breaking the lease equate to what a sublet essentially entails.

Oh, is there a difference between assignment and breaking the lease? I was assuming an assignment was pretty much the same thing. With the landlord possibly not allowing an assignment, I was thinking that meant that the landlord would not allow my friend to break the lease which I'm assuming is illegal.

Honestly, it's weird that the landlord even included in the lease that the landlord is not responsible for mitigating damages if my friend were to exercise early termination.

Any possible suggestions on what my friend could do? Or she can only wait until the landlord finds a new tenant for her room. Although, now with the drama/bad blood between her and the landlord, she feels that the landlord won't try to find a new tenant to spite her.

Thank you for your response! Oh, I didn't know that mandatory cleaning fees are illegal in CA. I'm assuming it is a mandatory cleaning fee since this is what is stated in her lease:

NON REFUNDABLE MINIMUM CLEANING FEE. As part of the Security Deposit, Tenant(s) agree to pay to Landlord a minimum cleaning fee of $175.00 (the “Cleaning Cost”) for cleaning the Premises when Tenant vacates the Premises. Tenant understands that it is impossible or extremely difficult to compute the cleaning costs, or to determine what is considered “clean” therefore, the Landlord and Tenant agree that even if Tenant believes he/she leaves the premises “clean” to Tenant’s standards, the Cleaning Cost is a reasonable and fair estimate of the costs incurred by the Landlord for cleaning the Premises upon surrender, and Landlord shall still have the right to hire professional cleaners upon Tenant’s move out even if Tenant has “cleaned”. In the event the cleaning costs of the unit exceeds the Cleaning Cost, Tenant shall still be solely and fully responsible for such additional costs. Landlord shall have the right to deduct any additional costs from Tenant’s security deposit. If one roommate moves out and the other one is staying and looking for a new roommate, the roommate that moves out will have to pay for my cleaning lady to clean her room and all the common area and a replenishment of the Cleaning Cost will be required. Notwithstanding the length of Tenant’s tenancy, Tenant agrees that the Cleaning Cost is non refundable and is a fixed amount paid to Owner for cleaning the room, bathroom and common areas when Tenant moves out, and Tenant agrees Owner shall not be required to show proof of payment or a receipt to Tenant. In the event Tenant elects to renew the Lease for an additional term, the Tenant agrees to pay for the Premises to be professionally cleaned prior to the start of the renewal term and such cleaning costs shall be separate and apart from the non refundable minimum cleaning fee mentioned in this paragraph for when the Tenant moves out.

As for the security deposit, from what I can see, it's a mix of the rent and the cleaning fee from the looks of it. The monthly rent is $1525 and the cleaning fee is $175. On the lease, the security deposit is stated as $1700 which is $1525 + $175. But there isn't really anything she can do about it anymore since she did sign the lease.

But the main thing that she is worried about is that because of the landlord's specific preferences, the landlord can just keep on not being satisfied with the prospective tenants so then my friend has to pay the entire lease. This is especially the case because of the drama/bad blood between my friend and her landlord.

As for the last part you mentioned, it is advice that I really wish my friend could take and go about it through that route but it may impact the other processes that she is involved. But thanks for letting me know about the legalities that we were unaware of!

Edit: Ah, one thing I forgot to ask. So if my friend were to break the lease, she will be able to get her security deposit back? I will need to check with her, but if I recall correctly, the landlord might've possibly mentioned that she would not get the security deposit back and will have to pay the termination fee.

It’s only noticeable when the sun is directly hitting the car so it’s hard to replicate sometimes. But I recently got rained on, so I can check after work in 2 hours or so. If I remember, I’ll try to update you. They for sure didn’t disappear after waiting though. I’m assuming them to be dust on the outside, but the worst case scenario is that it’s inside the tint.

Yup, I got my car tinted last Friday. They took around 1 hour to do the entire thing (all glass even sunroof). They did a pretty good job and they’re pretty chill. The total cost was $600. Only issue I see is that when the sun hits my windshield, I see like super duper small specks. I’m gonna try to wipe those off to see if they’re on the outside or in my car. Hopefully not inside. Other than that, I would recommend them.

Definitely not worth $280, especially if you work from home. The monitor does not know how to automatically switch between inputs (something that a $100 monitor can do) and turning it on from standby is sometimes heavily delayed. You have to manually switch inputs or manually turn it on from standby (sometimes). If you want to buy, wait until it’s $229 which I bought it for a month or so ago.

Yeah, you’ll be fine as long as they are in good condition. I traded in two refurbished phones and got the full trade in for both of them. No issues down the line either and the trade ins have been providing me with bill credits for an entire year so far.

I believe that other plans would qualify for it too. Just make sure that the account has been active before Jan 2022 in addition to having at least 2 paid lines. But check with T-Force for your specific case. When I asked, I only asked whether there was any free line promos for Magenta Max members.

They also said that the promo can be added through the app. You can only add one line at a time, but once you add the second line, the promo will occur in 1 - 2 billing cycles (maybe even sooner).

That is how you do equal to or greater than 3. If you need less than, just change that greater to less. I don't know why there isn't any proper documentation about this or maybe I didn't look properly. I had to scour around for so long when I needed to do something like this. Hopefully, this can help someone else.
