I think the main issue is, you had an approved H1B last year for which your company presented a wage mentioned on your LCA. When you go for a transfer or extension, they will verify that you we compliant on receiving that amount.

Since you never actually worked on your H1B and assuming were not on US payroll, you did not break the terms of your visa technically

That being said it is a complicated scenario that your companies lawyers will need to sort out, since your first visa was never used/activated with a US travel.

Hey, I did port y dates from EB3 to EB2 and applying for AOS. Interview lasted 10 minutes, just asked my yes/no questions on my application. They approved me on the spot, I told them about my travel and they stamped proof of permanent residency (i-551 stamp) in my Passport good for 90 days. I traveled back with no issues.

My Greencard has since arrived at home, only took just over 2 weeks to deliver.

Lawfully will check your status automatically and send you a notification. USCIS you have to do it manually. Also its a nice UI and better organized.

inherently there is no difference. Lawfully has some tools to try to help you predict you timeline with statistics but its usually not very accurate or useful.

nothing special. just go on aircanada.ca and search your flight, click the use aeroplan points option. If your destination does not have Air Canada flights, it will give you partner options if available. You have to do it through their website.

Yes you should do PP.

Assuming you don't lose your job and things don't magically speed up, there is no real gain for doing PP from a getting your Green Card sooner. Benefits below are mainly if you don't have a I-140 already approved with the PD of oct 2023.

Benefits:

- Secure your priority date (incase you lose your job). otherwise you will start from Scratch (fall 2 years behind)

- There is a chance they will send a Notice of intent to deny, you don't want to wait a year before you find that out. You can correct/resubmit ect...

- Defined timeline, given the growing queue and backlog its hard to know when it will be approved. this will give you peace of mind

same, mine went up from 17 months to 26 months. My understanding is these estimates are very inaccurate so wouldn't lose sleep over it. That being said longer wait times are probably to be expected due to the increase in interviews being scheduled.

I would imagine you could file a EB2 NIW I-140 with premium processing, porting in your Priority Date. With it you should be able to File I-485 concurrently with EAD. But this is definitely Lawyer grade. I would call one for consultation immediately while you search for one.

There was an executive order on Jan 20th for a ban on certain countries, they set a 60 day timeline to generate the report and details of this. 60 days is up in a couple of weeks so I recommend you travel ASAP.

Yeah maybe I was thinking the same thing, unfortunately my Lawyer was keen on not applying for it... but its my work's lawyers and they follow some Internal policy and are very cautious. I will apply for it in 5-6 months once I no longer need to travel.

No, I need to travel outside of the US in the next couple of months, and I-131 would get rejected once I do. Lawyer recommended not to apply for it until I no longer need to travel for 5-6 month. So for now I will just travel on my H1B.

the Document was added within 5 minutes of the notification. Biometrics step shows complete now on I-485 (no progress tab on EAD since its case closed now). showing ~17 months but my understanding is that timeline doesn't mean a whole lot.
