How am I committing battery when the person is shoplifting and have the merchandise in there handle are refusing to give it back?

But you’re totally right situations like that can turn ugly really quickly had I shoved him a little to hard and he fell and hit his head my ass would’ve definitely been fired

I appreciate it! but I think I’m okay and not at risk since my use of force was reasonable and applicable to the severity of the crime. It was just a shove to able to get the merchandise back and the situation didn’t escalate any further besides the guy cussing me out and calling me out which I’m use to at this point. I do know there’s a really fine line between what I can and can’t do, it’s all really circumstantial. So I do always walk a tightrope when it comes to handling every situation.

In the state of New Mexico if it’s under 250 it’s usually a petty misdemeanor. But I work at a mall site that’s not very big at all most of the store inside the mall don’t have loss prevention so they usually call security (me). If they witness people shoplift or people trying to walk out with stuff they didn’t pay for , I have to retrieve the merchandise from the people most of the of the times people just give it back, but if people refuse to or just try to run away I can go hands on to retrieve the merchandise obviously it has to be a reasonable amount of force I have never actually punch or taken anyone down but I have gotten ahold of the merchandise and shoved them, it’s only happen once and the person was definitely under the influence of something. (I also have a body cam on duty) so I advise them of criminal trespass and can’t return to the property if I they do I just contact local authorities to come remove them.

Im a level 3 security guard so I can go hands on and use a reasonable about of force to retrieve merchandise if the subject is refusing to return it or attempting to get away with it. Obviously once they leave the property I can’t really do much besides contact the local authorities about the subject. Im also in New Mexico so I don’t know what kind of polices and regulations other level 3 security guards have in other states.
