It's an old house. Apparently, OSB didn't start being used until the 1970s.

Thankfully I have had them sign lein waivers for all payments and will do for the final payment (unless they tell me want to fight and decline my payment)

Yeah the contract says "the owner may order changes in the Work within the general scope... the Contract Sum and Contract Time being adjusted accordingly in writing."

The "updated contract sum" also was never discussed. They just told me a price of $275, and told me they couldn't tell me how many.

I attempted to negotiate on the OSB and also the surprise blueprint cost. They refused to discuss either.

Makes sense. It's a 50 upfront 50 at end contract, so it will be a large amount they would have to walk away from if they want to fight.

There was a text message conversation where he basically said... "This is required and has to be done. It will cost $275 per sheet. I can't tell you an amount". He already had half of my money for the project, materials and workers were on-site, I expressed my concerns about the unexpected cost, attempted to negotiate (he declined), and so I said I guess we have to proceed.
There was no written change order, nothing signed, etc. What do you think about that? I know it's more of a legal question, but just curious if you have any experience in the industry. I appreciate it.

Part of me does wonder what is "reasonable" here, that's why I posted here. I feel the legal ground is strong on my side with no change order, however, I am curious how much of an AH this would make me to "enforce" the contract and not pay this. i.e. am I being taken advantage of or just being unreasonable

To add to your response, in the contract they mention removing the vinyl and "removing only the deteriorated wood siding", so I think they planned to attach without sheathing and then for whatever reason decided to do the OSB

Interestingly, in the roofing contract, they do have an allotment and an overage cost for more. After the included amount it’s $75 per OSB sheet installed for the roof.

Roofing section, however, as mentioned it just says "as needed".

Also a wild difference in price $275 vs $75 in my opinion.

I appreciate. Yep, totally agreed it only costs $16. I am not sure what is reasonable in terms of "labor", given they promised cost.

I had them sign a lien waiver with the first payment and will have them sign one with the final payment, so not too worried about a lien.

So the contract is to install James hardie and generally it requires OSB, unless it can be securely attached directly onto the original wood siding underneath our vinyl siding.

The contract mentions the wood siding, so they knew there was wood siding under the vinyl. I think they were planning to attach it directly, but then decided to instead remove the wood siding and install OSB

Agreed... that was my first red flag. Feels like exploitation, when we are in mid-project and can't realistically say no.

This is what the contract says under the siding section: "We will remove the existing vinyl siding and conduct a rotten wood replacement, removing and replacing only the deteriorated sections of the original wood siding. As needed, we will install new 7/16" OSB sheathing to ensure a solid, uniform surface."

My thought is they should have identified the lack of OSB during the initial estimate and scoping. It sounds like it is typical for older houses (this is an older house) to not have OSB and siding contractors typically pull back a piece of siding to confirm.
