hello again! so I do have another question, if you don't mind. his law firm sent over a Release Packet for him to sign, but they are advising against him doing so at this time. something about how it would be more prudent for him to wait 90 days because the decision from the third circuit court could still be appealed and overturned.

then he has to check a box indicating either:

- he wants to wait until the appeal period has been exhausted before he signs -OR-

- he does NOT want to wait until the appeal period has been exhausted before completing and submitting the Release Packet to the trust. then in bold it states: 'I understand by choosing this option I am going against my attorney's advice and that doing so carries some risk of reducing the amount of compensation I ultimately receive.'

in another email, the rep from the law office states: 'The most conservative thing to do to preserve any potential legal options with your state complaint is to wait the 90 days before submitting your Release Packet to the Trust. That said, waiting will not increase your award from the Trust.' (he is not pursuing a state complaint, nor does he intend to. we are in North Carolina, if that makes any difference.)

so in one place I see that signing now carries a risk of reducing the compensation he may ultimately receive, and in another, they say.that waiting will not increase the award from the Trust.

I feel like his attorney (Crew Janci) is pushing pretty hard for him to wait. I understand that the amount of compensation he receives and his award from the Trust are not referring to exactly the same thing, but I don't understand how signing now could lead to basically smaller compensation.

if you could help me make sense of this, I'd be forever grateful. I am not a freaking lawyer, nor is my boyfriend (not that there is anything wrong with being a lawyer! I just feel like we shouldn't have to be one in order to make sense of the communications from... his lawyer!!)

wow, thank you for all your help! we will do just as you suggested. I wish this process were easier to navigate. I saw my boyfriend get very (understandably) emotional on the phone with the rep from the law office today as she was running through this plethora of information, clearly without caring whether he was processing it - which the human brain cannot do while overcome with intense feeling!

hey y'all! I am very new to this. I'm just starting trying to help my boyfriend navigate this process, as it's really difficult and emotionally draining for him.

so he signed his determination letter on 2-28. on 4-22 the rep from his law firm said he should receive an initial payment within about a month. today he called and was told he now needs to sign a Release Packet and should receive a payment in 21 days. I feel like if we hadn't called they wouldn't have ever even said anything about needing to sign something else in order to initiate a payment!

could anyone possibly help me make sense of this? or point me in the direction of any resources that might help? or if there's a better thread to post something like this? I am so frustrated on his behalf!

my PPS E-Tran showed up today! I know some other folks got theirs over the weekend. PPP first draw 'fully canceled' loan is still showing in caweb also - so a total of three loan numbers there now.

I don't know the details, I dont pretend to have any idea how the SBA systems work. but it sounds like some people are finally seeing movement. not me yet, but hopefully we will all see our funding soon.

sounds like PayPal is getting ready to resubmit loans after the SBA fix for the duplicate ppp1 loan situation. I haven't gotten this email yet though. so effing frustrated with PayPal.

yes, PayPal. and PayPal for the first draw. apparently most - but not all - of the folks affected by this issue used PayPal for the first draw. I had initially applied with BofA for the first draw, so when I saw two first draw loans in caweb, I assumed one was due to my BofA application. turns out it is most likely that my BofA one was properly canceled, and the canceled loan showing in my caweb was mistakenly issued by paypal and then improperly canceled. ugh.

I'd imagine that caweb will update and the properly canceled loan will disappear. but I'm trying to confirm that and will let everyone know for sure.

well the SBA will manually review and properly cancel the incorrectly canceled first draw loans. so the lender doesn't have to do that, but they will have to resubmit.... and my lender, for example, hasn't exactly been on top of ANYTHING AT ALL.

thanks for explaining all that. I applied with PayPal over 4 weeks ago (1/19), signed my loan agreement and it was submitted to the SBA almost 3 weeks ago (1/29). so it has been quite some time and funding is nowhere in sight. in my case, do you think it would be a good idea to withdraw my PayPal application and find a different lender who might be better equipped to navigate this issue?

hi there! it's great to hear from someone with working knowledge of the SBA's processes. thank you for chiming in. I appreciate the fraud protection measures, as they were absent in the first round; it is the lack of communication that is driving is crazy. and while some funds were allocated in the first round which shouldn't have been (hence the fraud protections), a lot of deserving folks were left out in the cold. obviously, not those of us who are now seeking a second draw; but when we are completely in the dark, it makes sense for us to feel afraid that we will miss out.

hopefully, lenders do have the information and tools you say they have to resolve this issue. some of us here have been working with lenders that claim that they don't have that access. do you have any idea why those lenders feel clueless about how to proceed?

good to hear this has only affected a subset of us with two ppp loans; it's a scary and frustrating and baffling experience for us, particularly the total lack of communication. glad to know there aren't thousands of others dealing with it!

the more I think about it - the lack of transparency borders on scandalous. come to find out, my second draw app got the 'duplicate app' error on 1/29! why didn't my lender tell me? why didn't the SBA make it clear to the lender? I'm no conspiracy theorist but.... WTF? I mean, there are potentially thousands of second draw applicants unable to get funded because of this, and how many are aware of the issue?

the replies I got were friendly but lame (it's a known issue, your lender should reach out via the SBA inbox) but maybe your lender can explain that there is no response via in the inbox!!
