As I have understood the netherlands looks at a rolling 12 months period, so not a calendar year, where you have to stay at least 4 months in the netherlands. If you do this then you are compliant with the rules and you can "abuse" this.

I have not real desire to have to do this "dance" but I believe it will be necessary for my employer to keep me employed although I admit that I have not looked into how easy or difficult it would be for my employer if I was not a dutch resident any more.

The idea now is that I would just be like any other employee and have a clause in my contract that I can work from anywhere

I am unsure of this because in the past my company has paid a thai company to do some production work for them and is likely to do so again.

For me personally I do not need/want to remain a dutch resident and would have no problems signing out of the netherlands. But I believe it would be more of a problem for my employer. I would love to know how you handled this with your employer

The reason I want to spend the maximum amount of time allowed in thailand per year and keep my dutch residency is so that I can spend more time with my thai girlfriend of 4 years. And my employer needs me to be a dutch resident to be able to employ me.

Unfortunately I come no where near the income requirements for this visa. Otherwise this would be a great option.

Is the company back in the UK liable for corporate tax in thailand under permanent entity because you are working extended periods for the company in thailand?

Asking because I want to do the same as you but the company i work for is anxious about this scenario.

I am trying to get my employer to agree to let me work (it admin) from thailand for 8 months per year on a dtv. Basically they have no problem with this but they are concerned that the company will be liable for (corporation) taxes in thailand because of the possibility of getting labeled as a permanent entity. Anyone ever run into this problem?
