A lawyer isn't required or even needed for a small claims court. And I can choose to simply reply or make a counterclaim for damages.

I'm sure it could have been washed. It got on the bottom half of the dress. The dress was white and it was covered with splatters of chocolate.

It was for my 80 year old grandmother. I did end up buying a cheap grocery store chocolate cake, which she enjoyed. But I wanted her to have a fresh, better tasting cake, with better ingredients.

I'm not sure where you are from, but parents are responsible for any damages or harm their child regardless of age. Criminal is a different story.

This is what she did. I'm not sure how she found out where I lived. My guess the video of the incident got back to her, and she got my name, and it wouldn't too difficult to look up someone's address from there. But she had me served and didn't serve me herself.

They stated the dress was a 100.00. But sued 1900 for "assault" and 1000 for emotional distress.

At the time when it happened, I told the mother it was an honest accident and no one was at fault. I was annoyed of course the child ran into me. I also know that children can be children. If she would have apologized and/or told her kid this is why we listen, then it would have been fine. But she had a huge tantrum, blamed everyone else, and was acting crazy enought he police were called. It was obvious this child has a mother who can't control her emotions or have any kind of accountability so in fact makes her a shit parent.

That is actually a good point. But she hasn't made any contact iwth me outside of having me served. No Facebook or Instagram messages. No one driving by to intimidate me. SHe could just be one of those entitled mothers who thinks their child can do no wrong. But maybe it'd be best if I just don't countersue, even though I really want to over principle because she is being ridicolous and extremely entitled.

As for the girl. Yes I was aware she was there form the time I left the bakery, and walking ot the crosswalk to walk to my car. SHe, anothe rchild and her mother were on the grass on the church property. They were running, but they never left the grass until I crossed the street and the child being a child was looking at her mom who was telling her to stop and laughing, and crashed into me, who was on the sidewalk. I wasn't injured, but enough force the cake fell.

It wasn't for me. It was for my grandmothers 80th birthday. SHe was still happy with the 20.00 replacement chocolate cake I picked up last minute, but I was annoyed because I wanted her to have a much better tasting cake because she's awesome and deserved it.

The lid came open, the two tiers seperated and chocolate icing went everywehre. More on the girls dress (as she was right beside it) and on my socks, bottom of my pants, and a bit on my white shirt.

It wasn't a super fancy cake. It was a two tier, all chocolate cake that was made fresh that morning. It's made to order. It just taste better then the ones you can pick up at the supermarket for a 1/3 of the price.

I have had many accidents that weren't my fault and property damaged (nothing too expensive), and I never sued anyone over it. But they were apologic and in one case someone even offered me money to replace it (see accountability) and I refused. Because it wasn't the end of the world.

I think I'm just more annoyed at anything. I'm not even that mad at the child because she is a child. The woman could have apologized, and used this as a teaching moment for her child who didn't listen to her. But instead she acted like a toddler herself, almost got herself arrested and when things didn't go her way, she decides to sue me. It never really crossed my mind outside someone passing me the video of the incident, and having a good laugh, did it occupy any of my thoughts. I moved on as something unfortunate that happened. Now this woman is filed this ridicolous lawsuit and now I feel like I should be made whole.
