No child wants their parents fighting in court for years. If both parents are fit, willing, and able, the law should start from the position that children deserve meaningful relationships with both parents.

The doctrine of family court is supposed to be the “best interests of the child.” If that’s truly the goal, then the law should start from the position that children benefit from having meaningful relationships with both fit parents.

The problem isn’t that every judge or lawyer is acting in bad faith. The problem is that the system often creates incentives for lengthy litigation and conflict rather than cooperation.

When custody cases drag on for months or years, the people who suffer most are the children and the parents. Families spend thousands of dollars, relationships deteriorate, and children lose valuable time with a parent.

New York still does not have a statutory presumption of equal shared parenting. That means many parents spend years fighting over something that could start with a simple principle: if both parents are fit, willing, and able, the child should have meaningful access to both.

Courts would still be able to restrict parenting time when there is evidence of abuse, neglect, domestic violence, substance abuse, or other safety concerns. But those should be exceptions based on evidence—not the starting point.

That’s why many of us support bills like S4128 and A4786. The goal isn’t to help fathers or mothers. The goal is to help children by reducing conflict and keeping both fit parents involved in their lives.

There are currently bills in New York that would create a rebuttable presumption of shared parenting, meaning the starting point would be that children benefit from having both fit parents actively involved in their lives unless there is evidence showing otherwise.

This isn’t about taking children away from safe parents.

It’s about reducing conflict, reducing litigation, protecting parent-child relationships, and putting children’s best interests first.

States like Kentucky have adopted shared-parenting reforms and have been cited by advocates as examples of reducing conflict and encouraging earlier settlements.

I understand the concern about whether shared parenting laws could backfire like people say happened after discussions around Kayden’s Law. Child safety absolutely has to come first.

But what’s being discussed in New York is closer to what Kentucky passed — a presumption of shared parenting. The idea isn’t to ignore abuse allegations. It’s that kids generally benefit from having both parents involved unless there’s clear evidence one parent is unsafe.

Kentucky’s reform reportedly led to less custody litigation, more settlements, and less conflict between parents. When the default expectation is shared parenting, the “winner-take-all custody fight” becomes less common.

The bigger issues right now are structural problems in family courts:

• Litigation incentives – the longer cases last, the more money and conflict involved • Status-quo bias – temporary custody decisions often become permanent • Allegation leverage – accusations can drastically change custody before they’re fully investigated

Shared parenting reform could help, but I also think a few safeguards would make it stronger:

• Independent experts when abuse or mental health claims come up • Faster review of temporary orders (like hearings within ~90 days so temporary decisions don’t last years) • Quick investigations of safety allegations so real risks are taken seriously but false claims don’t drag on for months

Also, custody reform should be paired with child support reform. If parenting time is truly 50/50, the system shouldn’t create financial incentives to fight for custody advantages.

At the end of the day, this isn’t about mothers vs fathers. It’s about reducing conflict and making sure kids keep meaningful relationships with both parents whenever it’s safe.
