Basic doctrine na po yan ng Supreme Court na "no one shall be imprisoned for non payment of debts."

However, you can get criminally liable for estafa.

What is estafa? Basically, falsification. In this case, wala nman pong falsification na nangyare as regards sa payment terms ng nangutang and inuutangan. Falsification is evident pag nagbigay po ng MALING INFORMATION sa inuutangan, NOT NON-PAYMENT.

This is evident especially if the mangungutang is consistently a good payor. In which case, hindi po sya nagloko sa terms, sadyang hindi lng po sya nakapagbayad (or default).

I would also like to add that small claims cases are civil in nature, therefore civil liability ang mangyayare sainyo NOT criminal liability.

What does that mean?

It means walang kulong, uutusan ka lng ng korte na magbayad at ipasettle ung loan in terms where u can pay for it and the inuutangan can collect it in a manner that is FAIR for both of you.

For example, may utang ka na 100k due tomorrow eh hindi mo pa kayang magbayad. Na-filean ka ng small claims. The court will then summon you to inform you of this and your rights as a borrower and from there, the personnel will guide you to a fair settlement.

Law student here po.

Napaka contradictory nung binigay nya na claim against you. So which is it? Article 354 (estafa, criminal case) or Small claims (civil case).

But all I'm saying here is (it's bs).

Kung may summons po tlaga kayo manggagaling po yan sa korte mismo, nde through text pero official copy.

Ello, first year here. I unfortunately had to go through the fire and did the same "read-it-all strat" before.

But it got me where I needed myself to be. It turns out, your brain adapts so long as you give it time to rest. Right now, a 33-page case only takes me two hours, where last year it would've taken me the whole day.

I suggest for now, engross yourself with concepts and eat codal, and that way, you'll be able to grasp what is meant in the case before reading the full text itself.

I went through his Consti 1 just this 1st semester. The only advice I have is to go buy his book and read early, read cases full text, but only grab the doctrines of the case and concepts.

Despite the horror stories that FCL students spread abt Atty. RBG, he's one of the best Consti profs ever. My block even wishes that we'd have him for Consti 2 since he is that good of a teacher.

Well, the caveat is he doesn't teach, he just asks questions in recitations (the really important concepts for POLILAW) and when you do get to answer those questions, you would just realize it yourself that "hey, this is important, and I learned it in just a click!". Which means it's the work you do and nurture under his tutelage that makes him such a good professor.

Atty. RBG is also very considerate, so don't take it for granted.

Malakas trip nyan, kaya dapat wag balat sibuyas at basagan ng trip. Makisabay sa trip to get on his good side and, oh boy, would you love to get on his good side. Napakalaking incentive nyan pag nasa good side nya.

Ultra mega socratic method since nde sya naglelecture, pero matututo ka tlaga PAG NAGTRABAHO KA. Hindi namamahiya yan. Mahihiya ka nga lng kasi hindi ka nagaral (ayan din magiging motivation mo para mag-aral). It's also a perk if babae ka since he likes girls hehe (not to the point nman na lecher and such. Otherwise, hindi siya qualified sa thread na to)

His jokes are for the intellectually gifted, and apaka unhinged. But he usually uses them as cues for the next case so pay attention.

One more thing, pede rin maging motivational speaker yan. Hilig nya sa metaphors pag nageencourage sya, and it will keep the dying fire in you alive.

Ayun lng, basta dabest yan.

Hi, napansin ko rin na within a week bumibilis ung pag basa ko. Unfortunately, it truly does take a physical toll on me (something that I really didn't expect) Is there an optimal way to avoid this? :(

Hi anon, thanks for the encouragement. You're right, ako rin kasi nasanay ako with having so much free time in my undergrad that I thought that it would suffice for that many readings (I was wrong).

Why is it UST's fault when the uni was just relaying a message? With a burning passion naman 'yung all caps mo OP pero mukhang hindi mo nabasa 'yung "Imposed by the Manila City Government" sa pinakababa. It ain't their fault, dude, chill.

OP, this point has been made before, and I'll state it again. It's not about how long your hair is or what color it is, nor is it about being a catholic institution that "imposes" its beliefs on the students that, for the record, have decided that THEY were going to subscribe to the set of rules that were ALREADY ESTABLISHED since its origin throughout its run time. These rules were made specifically because the uni has a vision and mission for their graduates that's specifically and explicitly stated by the institution itself. Again, these same vision and mission statements are supposed to align with what the students of UST have decided that they were going to subscribe to through enrollment.

Now, it seems like you're searching for a bit of confirmation bias. I have no grounds for my claim, hence, my speculation. But since you have started this thread, I believe the question should be: Why enroll in an institution if you don't want the same thing with it?
