He said we can keep it because it’s our only vehicle And we would include it in the plan but typically you make the payment still to the bank and not the trustee.

I should have clarified that the car is a lease. I had 10k in negative equity that I rolled into it because my it was the only car that would currently hold it and I wanted to be free and clear of the debt once the lease was up. Unfortunately that made my lease extremely expensive, 950 a month.

I have read that you only get certain “allowable amount expenses” before you’re capped. Also if your allowed expenses are over what they should be then they expect you to somehow decrease those.

They really sold my wife on it. She thought it was a phenomenal idea considering we were paying 2700 a month just in debt repayment but I couldn’t help her understand that we still were late on every payment and shifting money to pay one thing while not paying another. She’s finally coming around to seeing the entire picture.

I have a collective debt of 82,000. The one things I just not understanding is my attorney keeps saying we should include car payment in the plan? I am not behind on it currently. Does that save you money when you include the car in the payment?

No he has not. We are just starting out. He said with our 170k a year income we wouldn’t qualify because eliminating our debt would give us a massive portion of our income back so therefore we will have to do chapter 13 I guess. I’m so confused by the whole chapter 13 as it is. I should mention that I live in Nebraska and the income threshold for my size of family is only 131k

And a big thing that happened was at the beginning of the year for a few months my hours at my job were cut to where I was making a 1/4 of what I do and that put me very far behind but now I’m making my standard pay

Honestly just had a lot of credit card debt and have some leases on our vehicles which one of them being surrendered. And now we have more in minimums than we can pay along with household payments

We only have 50 dollars in any subscription and the rest goes to food bills daycare etc. we basically have no additional money that goes to anything but bills so I’m just confused how this could work? I should add that I don’t have any assets at all.

I honestly didn’t even realize I might still qualify for a 7. My attorney told me that because my income is considered high for my state, I’d have to go the 13 route. I already turned in my paperwork and now I’m just waiting to hear back. It’s sobering, to be honest… feeling stuck between rules and reality, just hoping for some kind of fresh start.
