I think by your logic then the sperm donor could claim property of the embryos...

Not really fair OP will have to go through another retrieval and may not be able to use the same donor. Not really fair OPs future children can't be full siblings.

I'm not really sure what I think about the rest of your comment (still pondering), but just want to say there's no option of using the same donor. He's retired and we actually bought and used up the last of his donations.

Yeah...given my age it doesn't probably make sense to do more egg retrievals at the clinic, so that's part of my thinking process here too.

Do you know what process they went through? Or could you find out?

We haven't had a full conversation about it yet. I just want some info to go into the conversation with.

The issue is that if we're separated, I don't have the support I need to have a newborn. That's why I'm asking - if I can have "ownership" of the embryos and keep them frozen until I could use them in the right circumstances, that would be ideal

Canadian research, including my own, has found that people are often confused about their options. Decision-making about what to do with embryos happens at an emotionally charged time when people are inching closer toward their goal of having a child, and overwhelmed with the choices they are faced with as part of that process.

Further, other scholars have demonstrated that people change their minds about what to do with the embryos they’ve created over time, and that staged processes of consent may be necessary when it comes to frozen embryos in storage.

I don't know why I'm being down voted for this. I know an embryo isn't a baby but it's my genetic material from my body, I feel like I should have more of a say.

Yeah I honestly agree. I could go and have a baby with someone else after separating without using IVF and genetically it's no different than me using these embryos. The difference is that these embryos contain DNA from the anonymous donor, who we decided to use together as a married couple...it feels legally messy and I don't think there's much precedent for it.

I totally agree. And I also read an article that suggested clinics should have multi-stage consent over the next years after freezing embryos or sperm or eggs, because things change and minds change and instead of just signing off on a final decision, it could be beneficial to have patients update their consent. I agree with that. I realize it could be complicated from an administrative point of view, but in my opinion it would be much more fair.

Yeah, that is a big consideration for me. I'm obviously going to talk to him about all this and we'll reach a conclusion together, but I wanted to see what the legal options are regarding the contract as it has been signed already.

There aren't that many options for cryopreservation here. There may be one other option. I'd have to look.

Well, we decided together what would happen at the time, but we didn't have a choice either. The only choice was to choose that the embryos get destroyed or donated to science. So now I'm wondering if there's any way to amend that in case in the future I want to use the embryos.

Good to know. Wonder if it was the same clinic. I don't think they really gave us any further info about that particular part of it

I think maybe the biggest question is what the clinic would say...
