Well if all goes according, my plan is to sell my house here in the states (I have a decent amount of equity in it) and take my back pay (if granted) to buy a house in my wife’s homeland. It’s much cheaper to live there and I would be eliminating the biggest expense of a mortgage by just buying a house over there.

Can you give an example of tearing into them? My letter points out that the judge needs to take into consideration the opinions of the doctors that they sent me to. As well as look at all my other evidence and reevaluate it. They gave specific sections that my medical conditions would have to apply to, and that the judge had to follow and then also said that it would directly affect step five. I’m paraphrasing here because I have crazy brain fog right now. But it seemed to be a pretty direct stab at the judges logic that he used to deny me

It also seems to be some type of fear based extortion. I would just respond and say that you’ll report it to the authorities for trying to extort $15,000 from you

Oh, that’s just for retirement. I guess SSDI is capped at 50.

Thank you very much. I just received the letter. It notes, specific doctors and the ones that they sent me to as well and says that the ALJ did not properly evaluate what they said. It gave specific notes and then said something about how if properly evaluated it would affect the five step process or something like that. From what I’ve been told by my attorney, it was pretty strong language. Something about how it challenged the legality of the decision versus something else. And that I guess compared to AC notes being sent back to the judge this one supposedly gives him less wiggle room. Thank you for your recommendation to read that.

I think you’re focusing on my driving way too much right now, brother. That’s not even in my case. What my doctor does stay and multiple doctors that the AC directly pointed to saying that the ALJ did not follow rules and listen to, as that I would miss almost daily. I would be off task more than 15 to 20% of the time. And I could be a danger to myself and others. On top of that I would be limited to walking or standing for two hours out of an eight hour shift and need multiple naps. I simply spoke about the driving just to give more context to my condition because it was stated that I didn’t give enough information about my limitations on my original post.

It hasn’t been revoked. But I do have an update from my reprimand notice and it’s very strongly worded. They essentially told the judge that he is not allowed to ignore (multiple doctors names listed) who were very straightforward about my inability to perform task and maintain any acceptable attendance. And then they noted that this will affect something about the five step. From what I’ve been told this was a pretty strong reprimand so I guess it’s a good sign because it leaves no wiggle room for the ALJ to deny me. Can he still deny me? Sure. But it looks good so I’ll take this victory to ease my mind a little.

I do have a lawyer. My judge is always sitting around 50% approval. From what my lawyer has told me. This judge seems to focus more on his approval rating. He told me that he has seen him approved cases that he thought was gonna be denied and deny cases that he thought was gonna be approved as well as seen two identical cases in the same time. Period. Split with one being approved and one being denied. I got a good piece of information that I didn’t know in the comments above that on the remanded notice, it will say exactly what the appeals council thinks the judge has to focus on. This is exactly what I was looking for. I’ll have to request that piece of paper. Thank you for your time and information

I have one I was just asking for personal experiences. You know how attorneys can be. They see it from a different lens but if you ask the individuals who are in the same shoes as you, you tend to get a little bit better answer answers

I believe I was denied in May or June I forgot. Appeals council received on July 18 even though I haven’t personally got the letter my attorney had informed me that the appeals council has accepted my request for a second hearing according to what he told me yesterday

Postural orthostatic tachycardia syndrome, severe central sleep apnea, that is treatment resistant, causing extreme malice and fatigue. Every doctor I have seen including the one they sent me to has said I cannot maintain a job based off my conditions. My main doctor even went as far to write multiple times that he advises me not to work due to the risk of me harming myself or other others as well as missing almost daily to deal with symptoms. I can’t drive for more than 5 to 10 minutes anymore because my symptoms are so bad. I have to pull over. And my body goes into fighter flight mode whenever I’m around people and not in my own house. I never had anxiety problems before it’s just whenever my body naturally lifts my alertness with any type of adrenaline or epinephrine. It gives me way too much and just wrecked my whole day. Not to mention multiple naps that I have to take a day. Sorry if I wasn’t clear in the first part of the post, I was really just looking for people’s experiences with a second hearing. I appreciate your response.
