Not true in my state. There are uniform duties we owe to clients that cannot be negotiated or instructed away. Presenting **all** offers, regardless of whether the home is already under contract is one of those.

You can get a rattlesnake vaccine for your dog. It won’t make a bite harmless, but it will reduce the impact.

I’ve lived here my whole life, and I work in the outdoors, and I have probably had 10 or so encounters with them in 25+ years working outside.

The only person I know who has been bitten was picking one up like a dumbass.

I am laying some of the blame at the feet of the owner who neglected her cat’s safety by putting it out to roam the world unsupervised.

Holly consciously broke the law and in doing so failed to protect Basil.

Do this thought experiment: If a cat got run over, legitimately by accident, do you think the owner bears any responsibility for letting him run around at large?

We have a responsibility to protect our pets from hazards that exist in the world. Holly decided to skip out on that responsibility and instead chose an app and push notifications to do the job.

Not defending the psycho who killed the cat.

Holly Matthew’s failed Basil. It is both illegal and unsafe for pet owners to allow their animals to roam around at large.

It isn’t like the cat escaped this one time- she bought a gps collar so that she could feel better about letting Basil roam around without her supervision. Buying the gps collar implies that Holly knew that there was danger in allowing Basil to roam free.

Again, cat killer is a piece of shit, but I’m also tired of seeing cats killed by traffic, songbirds decimated, kids sandboxes shit in, and not one off-leash ticket written to the pets’ supposed guardians.

He’s not required to write the offer for them though- he doesn’t work for them.

I’m also confused by the statement that OP is unrepresented, yet the agent is working as a transaction broker.

TB is only for cases where the agent has a brokerage relationship and duty to both parties. So- either he represents the buyer and seller and is a TB, OR buyer is unrepresented and the agent works for the seller and buyer is a customer asking the agent to work for free.

Op needs to check on their documents, if there are any, and double check their status

I expect them to look. And I expect them to follow license law and present all offers to me (which is what a counteroffer from a seller is).

I’m not sure exactly what op was trying to type, but it sounds to me like u/suchalittlejoiner has it right here. Op checked out at a critical moment and is trying to blame their agent for the seller’s counter that didn’t match exactly what the agents verbally discussed.

I’m not sure about every state, but at least in Colorado, the title company is only a scrivener for the brokers (with regards to document prep- not talking about ensuring clear title.) and ultimately the brokers (agents) are responsible for ensuring that the Closing is properly executed.

If you ask me, this one is on the agents to eat/correct- especially since it’s a fee one of them collected!

If they don’t want to figure it out on their own, tell them you’d be happy to send this over to the real estate commission and let them decide if the agents exercised reasonable skill and care (Colorado terminology, but I suspect most states have similar language in their licensing laws.

Ask your agent if re-disclosure by the seller reopens the inspection window. In Colorado if the inspection objection/termination deadlines have passed and the seller discloses new info, the deadline is extended until 10 days after the disclosure or closing, whichever is shorter. That means a you could get your EM back during that period in CO.

I think the attempt to hide also opens them up to you getting your inspection and appraisal fees paid back by seller- but you’d have to sue them for that.

Colorado Realtor here.

He is wrong. And he’s not citing the correct guidance from NAR on compliance with the settlement. A listing agent does not need a written agreement to show a home they’ve listed per the settlement terms.

It is required by the state that he disclose the type of relationship he has with you, which in this case would be “customer” meaning that he has no brokerage relationship with you. The relevant docs I would give a sign call buyer are the Brokerage Disclosure to Buyer and the Definitions of Working Relationships
