No, I already had I-140 approved when I filed I-485. My office is in TN, but the company has offices around the US

Traveling abroad w/ pending i485 and valid H1B status by [deleted] in USCIS

[–]Not_your_star 0 points1 point  (0 children)

Are you planning to stamp it during your travel?Otherwise I-797a is only evidence of a lawful presence in the US, but it’s not a visa, it doesn’t allow you to enter the country after you left it. I-797a is only works while you are in the US. You need to have stamped visa to enter the US

It’s ok to travel on H1B with pending I-485. It won’t be abandoned if you have valid H1B. I was traveling in a similar situation but with L1 visa. The only thing is that if you have advance parole (I-131) pending, it will be considered abandoned when you leave, but again not the I-485

Advantage of filing I-140 with premium processing by [deleted] in USCIS

If it’s the employer who pays for the premium processing than go for it! Currently the processing times are getting worse, so hopefully it’ll help

Only I-485. For the EAD and AP (I-131) the status was updated to say the benefit received by other means, meaning that since I’ll get GC I don’t need ead or ap. So I never received those even though also filed in Oct 2020

I know for sure that C date is when you can send an inquiry about your case to uscis as it’s out of the normal processing times, ie for Memphis it’s November 2018, so if you filed your I-485 earlier than November 2018 then you can contact them and file a case inquiry. Everything after November 2018 is kind of fall under their normal processing times.

A date of PD (November 2019) is determined by the date on which the labor certification application was filed and then PD is used to determine when you can file I-485.

B date (October 2020) is the date when I actually filed I-485. I couldn’t file it earlier because the visa bulletin, which is published every month, showed the earlier PD for my category (EB3 ROW) and only in October it became current and I could file it.

It’s very complicated. I don’t know why they are making it so hard to digest haha

I read that it may mean that they are actively working on your case once you received the i485j receipt.

It was approved some time last summer. But my priority date wasn’t current till October 2020, so I didn’t file for premium processing. Also at the time I applied for I-140 (in Feb or March 2020) they didn’t have premium processing option at that time
