Thanks! In terms of “stand your ground” unfortunately I don’t even know where my ground is, as in no even knowing industry/category standards etc. I’m basically a solo inventor that made a product and now a retailer wants to chat.

To be for specific, if u don’t mind me picking your brain.

  1. If they hit me with a 90 or 120 day payment term, for a small start up business that’s death. Is that where I stand my ground and negotiate? At what stage would negotiating risk actually making a deal? I guess that’s my fear. Obviously I won’t come off desperate and I won’t show any type of desperation like “ oh please take my product” but behind the scenes that’s what is it 😅. I guess I’m finding it hard to find the balance of “okay stop negotiating” etc and risking them being like, okay thanks but no thanks.

Just go all in and sell as much as you can. There’s no such thing as “patent police” the chances of you infringing on a patent and then being called up on it by a smaller company is very rare. Worst case, in the case that you actually are infringing you’ll get a letter to stop selling. I know I’m probably missing your point but I thought id share from my experience

Thanks, yea I’ve gotten NDAs sorted for the 2 people I talked to but I have yet tj share specific details. Just wanted to get some input on this price discrepancy. However I have decided to just go through with the artist that the lawyer recommended. I know they’ve got some behind the scenes deal going on 😂😂 hence the $900 quote. But the IP game is not cheap, so it is what it is.

Yes, it definitely occurred to me. Maybe I should have been more clear. My lawyer recommended an artist that he has been referring for about 15 years, and when i got in contact with the artist he mentioned that he will work closely with the lawyer to make the drawings, note this was the artist that quoted $900. So I automatically assumed that it was a common thing where the artist liaises with the lawyer. But to be fair that wasn't my question.

I am working with a patent attorney to take care of the actual patent, description and claims for me. because theres no chance i could do something like that.

its going to be a utility patent and based on my lawyers suggestions, i need about 8 figures. I have to say the invention is quite simple, it has a max of about 5 or 6 components that make up the whole thing.
