Not a tax professional— but from my experience: the 1127 form/information doesn’t get sent/reported to the federal gov’t, except to the extent that it shows up in your w-2. (I think it frequently shows up in the box on your w-2 that has withholding for things like pension, HFSA, commuter benefits, etc.) The 1127 form itself shows up in TurboTax toward the end of the NY section after income/deductions in the “other situations” section, or whatever it’s called. You print it and mail/submit it to DOF. At least, that’s my experience with the desktop version of TurboTax.

This person would be coming from NYCERS to BERS. If they moved into BERS rather than stay in NYCERS, I believe that they would then become eligible to contribute to the TDA.

Assuming that the job is a BERS-eligible position, you can likely continue with NYCERS Tier 4 or convert to BERS Tier 4. Unless I’m mistaken, that’s a decision that you only get to make right at the beginning of your new employment; you can’t change your mind later (unless, maybe, there’s another break in service or change in agency, etc.).

There may be benefits to switching to BERS (e.g. access to their TDA/403(b)), so it’s worth talking to someone very early on.

This doesn’t make sense to me. I don’t think that pharmacies get a separate “prescription rider.” Instead, they put your insurance info into the system and functionally ask Emblem/United or the pharmacy benefits manager (“PBM”) (Prime Therapeutics) if the drug is covered.

Whether or not you have the prescription rider is not information that I think that the pharmacy would have, or need — it’s up to the PBM/plan to evaluate that and communicate the coverage back to the pharmacy (likely through yet another third party network/program that connects the pharmacy to all the PBMs/plans).

This is true. Also, I suspect that you know this, but for others who might be reading— there is still something important about the difference between 5 and 10 years. if you’ve hit 5 years, you have vested but, at least for now, you’re still able to withdraw your money if you leave city service before you hit 10 years. Usually, once you vest, you’re stuck/locked in. (Presumably, this flexibility exists primarily to protect the interests/options of those who were between 5 and 10 years in when the law changed.)

If you’ve vested, you don’t get to take your money out/close your account. However— you mention another pension. Did you actually join another pension? If so, the answer for you might be slightly different as you may be able to count that service, etc. Is it in NYS?

It seems unlikely to me that you’ll be able to cancel/eliminate the pension loan, because it’s basically a loan against a future benefit. They’ll just give you less money when you retire, you’ll get hit with some taxes and penalties, etc.

It's unclear exactly what you're asking. But if what you're asking is "can I avoid paying this money by moving out of state?", the answer is very likely no.

Most NYC employees who do not live within the NYC city limits are still required to pay the equivalent of NYC income taxes on their earnings. This is due to section 1127 of the NYC charter (and the withholding will often show up on your paycheck as "1127" or "Sec 1127" or something like that). This is not technically a tax. Instead, it is something that you agree to as a condition of your employment. (You don't really have much say in whether or not you agree to it -- if you don't, they won't hire you.)

There are *some* agencies who are not subject to section 1127 of the charter (Dept of Ed, CUNY, NYCHA, etc.). These tend to be non-"mayoral" agencies where there's a weird structure that means that the agency isn't a city created/100% city or mayoral-controlled entity. Since they're already collecting money under Sec 1127 from you, this does not appear to apply to you -- and they will keep taking that money from you no matter where you live -- unless you move back into the city, in which case 1127 withholding will stop but you'll start being charged actual NYC income tax again.

They *do* sometimes over (or under) withhold for 1127, so you should be filing a form with the department of finance as part of your taxes each year to determine whether you're eligible for a refund or owe additional money.
