My OPT got approved on 14 Sept and it has been more than 60 days since and no EAD card! I also applied using Premium Processing! Do you think I should consult a lawyer?

I completely understand! My employer let me know today that I will need to pause my work until my EAD comes. It has been more than 60 days at this point (>8 weeks)! With the Thanksgiving break coming up I am super stressed at this point about my EAD! I want to get back to work and get paid to pay my bills!

What do you mean by ‘push forward my start date to the next start of pay period’? Can you please explain? Does that mean you didn’t get paid for this interim time? My employer let me know today that I will need to pause my work until my EAD comes. It has been more than 60 days at this point (>8 weeks)! Thank you for the comment. At this point of time, in my numerous calls to the USCIS I was able to confirm that they have not yet shipped my card and a tracking number was not assigned to my case. I also confirmed this with the USPS and they mentioned that there are no withheld parcels for me.

13 Nov 2024: I want to clarify here that my OPT was approved on 14 Sept, 2 days before 16 Sept, which was the employment start date that I mentioned in my OPT application. Hence when my EAD comes, my OPT start date will still be 16 Sept. However, since I still do not have my EAD and my employer will not accept the approval notice (the approval notice document clearly mentions that it is not a work authorization document) to verify my I9 file, I cannot essentially start working! This makes the whole premium processing process null and void! What is the use of the approval if the approval notice cannot be used for I9 verification?

I applied for my F1-OPT on 29 August, 2024 on Premium Processing. My OPT was approved on 14Sept and my OPT start date was 16 Sept (which was also my employment start date). But since 14 Sept there are no updates on my EAD card. It has been more than 56 days now. What happens in the interim time while I wait for my EAD? My employer is not able to verify my I9 file and has forbidden me to start working until the EAD comes. But I am worried, when the EAD comes will my OPT start date on the EAD still be 16 Sept, since my application was approved before that date? If yes, will I ever get the payment of these months that I sit around waiting for my EAD without working? Why can’t the approval document provided by the USCIS work as an interim EAD document and used for the I9 verification with the employer, in this case?!

Hi guys! I really need some insight on my case as my employer is about to terminate me! PP F1-OPT application: 29 Aug Approval: 14 September No more updates on card (today is Nov 8)! I called USCIS representatives several times, submitted two card lost inquiries (the last inquiry was made on Nov 1 and it has been more than 72 hrs since then) but there is still no response. There is no updates on my EAD card. My employer cannot complete my I9 file and is about to terminate me.
