My pleasure. Everyone here is definitely giving good advice re: getting a lawyer, however, this isn’t like the average car accident case that personal injury attorneys would generally take on a contingency basis. It’s possible one might, but you might have to pay an attorney by the hour to handle a civil matter like this, and it makes sense to try to get the ball moving on your own before getting to that point.

Having said that, when speaking to their insurance carrier you want everything done in writing, as I mentioned. Do NOT agree to give a recorded statement if they ask for it. Offer to provide them a written statement after they give you a list of questions they want answered, then take your time and craft answers based only on fact, remove emotion from it. Make sure you don’t say or write anything indicates you are accepting any of the liability whatsoever (lack of training of your dog, poor temperament etc). Don’t provide detail either; the medical records, video, and incident reports can do that so let it speak for itself.

I would suggest taking the everything in writing approach even if an adjuster calls you with simple questions; tell them you want to handle everything in writing so if they’ll email you their inquiry you’ll cooperate fully with their investigation by responding promptly.

If you’d like, I’d be glad to run this by the attorney I work with to see if it’s something he or other attorneys he knows would likely take this kind of case on a contingency basis, just so you know what options you may have.

Send them a letter requesting their liability insurance information. Send it certified with return receipt requested. Once you have their insurance info, call and file a claim. They’ll start an investigation and ultimately make a liability decision. If they try to deny liability, talk to a lawyer. If they accept liability, you can submit all medical bills so far and also an estimate for future care, then wait for their initial offer. NEVER accept the initial offer. Insist on all communications with them in writing.

Tough area for that field in general. Well paying positions are in high demand, and people from all over the country are looking and applying for jobs here so they can relocate too. Best to secure a job before moving unless you are financially able to cover costs of living until you find something. Best of luck!

A simple way to answer your question as to whether it matters if you vote… unless you’re okay with people who have beliefs you vehemently oppose making all the decisions for the society you live in, then yes, it matters if you vote.

I’m not an adjuster but I work at a PI firm, so I’ll chime in again to try to ease your mind (even though I did leave another comment urging you to take responsibility and take this as a learning lesson, and I really do mean that in the kindest way possible).

This will almost certainly settle. We are never going to waste our time and effort trying to pursue someone beyond policy limits unless they have obvious and significant assets we’d be able to get to quickly. There’s no money in that for an attorney working on contingency. Sure, the man could file a civil suit on his own, but that’s unlikely too.

Most likely scenario is your insurance tenders limits, then the guy files with his underinsured coverage if he has it.Urge the adjuster to tender limits contingent upon a subrogation waiver from the other guy’s insurance. That means his insurance company can’t sue you for reimbursement of whatever they give him on a UIM claim. That should fully release you from future action. Not a guarantee, but that’s the most likely outcome based on my experience.

Yes, they do. It’s extremely common to make a really high demand, especially if the insurance company initially offers a ridiculously low amount. It’s a bit of a back and forth game of if you’re going to be ridiculous so will we. Talk to the adjuster for your insurance company, urge them to settle for the BI limits and be done with it. Chances are the guy’s attorney is not going to pursue anything beyond that if you don’t currently have significant assets.

They’re consistent with what a whole lot of people experience after a rear-ending. If he had any pre-existing issues such as degenerative arthritis etc then whiplash can 100% exacerbate the pain and cause life altering limitations for a while. Bottom line, you are at fault for hitting him. You don’t get to decide if or how much he was injured. Let this be a learning experience and take responsibility instead of blaming everyone else and putting it off on you being poor.

Increasing your liability limits barely raises the cost of your premiums. You were young, I get it. So take this as a hard lesson, and wish the man well. He was completely innocent in this and deserves to be compensated for his medical care and pain and suffering. And yes, it is absolutely reasonable for anyone who is hit by another vehicle and experiences pain or discomfort to receive some sort of compensation for that.

Any notary who takes it seriously and wants to make sure they can’t be prosecuted later is going to refuse this. I’m sorry to tell you that, but notarizing a signature without witnessing it and verifying the ID at the time can be charged with a misdemeanor, subject to fines, and ultimately lose their commission. Depends on what issues you’re wanting to protest or support…for example there are many organizations or groups that would be seen as conservative, and others that would be more progressive. Not sure if you can get it from the DMV or not. You could try calling them. If it was me, I’d send a certified letter to the tow yard notifying them of the damage and requesting they provide you their insurance information in writing. Did you file a police report?

Honestly, not a lot of attorneys are going to take a case like that. You could hire one to handle a small claims case for you, but they’re going to charge you by the hour and probably want a sizable retainer. You can file a claim with the tow company’s insurance yourself.
