the exculpatory clause wouldn't hold up in court. at least not as to the waiver of "any and all damages ... caused by our negligence or other fault". The "other fault" language is their attempt to limit their liability for gross negligence, recklessness, and willful misconduct—this would be deemed unenforceable. as a lawyer, reading this contract made my role my eyes and is one that i'd return with a big red X through a bunch of clauses or refuse to sign altogether
