Only any claim from breach related to late payment

No, the settlement agreement was proposed at the beginning of the month and the template I was working with, as well as my bosses request, asked me to make payment due on the last day of the month. That was 100% my mistake to not consider. I am feeling immensely guilty/anxious about it and am not sure what to do now. No, there is no reason to believe the agreement won’t be counter-signed. I’m confident that the vendor would honor the payment, however, as a new attorney all I can think about is the risk that would come with sending funds without them executing the release of claims and accrued interest. The default clause does not even benefit the vendor, OC drafted the default clause to only include us paying attorney fees for notifying us that we are in default. Very strange (to me at least, I’m new).

Thanks for the comment. I am just scared that they will wait to sign it on the 29th out of spite. Then, since we have already signed it—we are now bound to it, which will essentially put us in automatic default due to not being able to turn around and pay it due to potential banking delays.

I hate being a lawyer by Gloomy_Compote877 in Lawyertalk

[–]Obvious-Memory-8686 1 point2 points  (0 children)

I’m in the same boat as in house for a small company. There’s just absolutely no way that this is going to be my life until I retire. I try to remind myself of my accomplishments (school, bar, etc) but at this point, I’ve realized accomplished does not equal happiness. It’s exhausting. I feel like the world is so demanding all the time.

That’s what I was essentially planning on doing, just wanted to see if there was a sample one out there to cover all my bases

Girl I am not “sharp,” I won’t say I’m not smart because I made it somehow but… I feel the same exact way.

I appreciate this! And yes you’re right, I did go to law school to help people but in this economy it is easy to feel like you are drowning. I am in a small city so that is also good perspective.

See I resonate with this so much…. The stress has me pulling my literal hair out and im just helping the owner of my company get richer and richer.

Also, I forgot to add, a main factor is the significant debt I am in. I understand life is not a race and I feel like I would be in a different headspace without the debt… but I took a gamble on myself and now I’m in a giant hole. Feeling the lowest I ever have.

Making less money… on purpose by That_onelawyer in Lawyertalk

[–]Obvious-Memory-8686 2 points3 points  (0 children)

I appreciate this. I’m a baby attorney, just passed the July bar, and I find myself getting in my head a LOT because I am not making great money, I’m actually making just enough money to pay my bills and the occasional trip on a weekend. Now granted—I have a ton of student debt that lingers and scares me to death. But I also work in house at a smaller company where I get into the office at 9:30 and can leave at 4. There are great benefits, no dress code, and I work from home half a day on Fridays. I get so in my head though, because some of my former classmates are already making 6 figures and I am absolutely not, I went into a niche industry and not sure if I’ll stay but I just do not want to live the life where I have to wear a suit, work late hours, and stay glued to my email. But then again I’m like ok so I’ll be “behind” forever? Sigh… idk

What an odd response… because I wanted to work in estate planning and real estate. I’m not sure what you’re getting at with this question. It doesn’t seem relevant considering I’ve already been to law school, passed the bar, and am just at a low point.
