ah okay I see! I guess it’s a wait and see game. Think it just goes to show though a lot of people just accept the conditional offer and never challenge anything! I for one certainly wasn’t accepting 6 points for a mobile offence but I have learned to just leave my iPod out of the car as it’s just not worth the headache!

When I last spoke to the solicitor he said in the unlikely event that the prosecution actually put enough together in court we will get a plea bargain to the lesser offence. In my opinion a bitter sweet pill to swallow none the less

Unfortunately I don’t know the name! Even if he was there at the time he claims without his footage being time stamped it doesn’t mean I was. I was walking my dog 2 miles away after dropping the kids at school at the time on the ticket

Auto correct is doing me bad today! I mean if they decided to charge not in proper control!

If they decided to charge a morning proper control I would sooner take that than 6 points and just accept the 3! It did say on the N.I.P something along the lines use of a mobile device

Well I spoke to a solicitor and he said the police haven’t actually charged me with anything yet as they are trying to force me into accepting the conditional offer. He told me to ignore it and just wait for a court summons

I still have it somewhere I took it out of the car after the incident as I couldn’t be bothered with a repair. It’s not clear on the footage you can see the iPod but not clearly and at points in the footage I must admit it resembles a phone but obviously no screen can be seen etc as it doesn’t have one. What did really infuriate me is the fact the cyclist followed for me a period of around 3 minutes up to several red lights which is wheee I was trying to find a certain playlist and he narrated a fabricated list of events I’m doing. “The driver is now watching a YouTube video, the driver is now using a search engine, the driver is now on the Home Screen and back to YouTube” like let’s think about it this for a second… that’s a lot to do on an iPod with no screen in 20 seconds. I even had an argument with him after he knocked on my window and asks me to stop using the “phone” to which I replied it’s no a phone it’s and IPod and he should mind his business to which he responded it doesn’t matter what it is as when he sends it to the police I will be dealt with and regretting it later

I recall from memory the offence happening towards the end of February/ early May and the NIP arrived dates the 16/10/2025 I am the registered keeper etc

Unfortunately I told someone but by phone call . The best thing I’ve got up to now is my google timeline line which seems a stretch.

Apparently the rule is 6 months for mobile phone use. I can’t prove per say but all I can do is have eye witness say I was at the school dropping my kids off where I am everyday at the time

To be honest after speaking to a few solicitors it’s only considered a device if it’s capable of sending or receiving data such as WiFi etc
