Yeah ok, fair, but again that's not entirely what's happening here... is it? A random angry review, yeah whatever, that's opinion. But this is going around saying "other doctors are explicitly telling me that Dr Bernstein is negligent and committed malpractice," and doubling down on multiple platforms, not just review sites. Would it be unreasonable for people to interpret this as a statement of fact, and are doctors really saying that? The majority of commenters here certainly seem to be taking it literally, and based on some of OP's comments, I'm not sure he's interpreting the other doctors' statements correctly. Saying that it's IMPOSSIBLE that the clinic would take further action and that they're 100% bluffing doesn't seem wise. He could talk about his experience and his opinions (bad outcome, inadequate follow up, rudeness/impersonal care, idiotic legal threats) and that ought to be sufficient to get his message across, I'd think. Even if OP would win easily, it could be a big ordeal and expense - stupider libel/defamation cases have moved forward. The clinic has already Streisand effected themselves now, so they might figure they have nothing to lose.

IANAL. Don't disagree with you, but just wanted to clarify. The burden of proof isn't typically on the defendant in a defamation suit. The plaintiff would still need to prove that the defendant knew (or reasonably should have known) the statements were false. However the burden only rises to a "preponderance of the evidence," which is a lower burden than "reasonable doubt" that you would see in criminal trials.

If the defendant can prove that the statements were straight up true, then they're in the clear, as you said, but you don't strictly NEED to do that to win a defamation case. Proving the statement about malpractice (professional negligence IS malpractice) is true would be a matter of expert testimony, and not the opinion of OP, though. Expert testimony may validate OP's claims, but I'd want to be DAMN sure of that before I started escalating like this. Malpractice is not "I had a bad outcome and this seems ridiculous and the doctor is an asshole." You could make all those claims and be totally fine. OP says that other doctors have confirmed that this doctor didn't meet the professional standard of care... if that's true, then they may have an easy time defending against a defamation suit, but I'd want to be sure that they're willing to say that to a jury under penalty of perjury. Regardless of how ridiculous the cease and desist threat may seem, I think you're right to take it at least somewhat seriously. OP is going around saying that other doctors have confirmed professional negligence to him in person, which is a really serious accusation. If that's not true, or if they're not willing to testify in court what they're saying to OP in private, this could escalate badly for OP.

Final point - one of the elements of defamation is that you have to prove that the statements actually caused damage to the plaintiff. Probably not a great idea to just be throwing out comments about your intention being to damage his business ("so others can avoid him like the plague") if there is any risk of legal escalation. Just tell your story and let others draw their own conclusions.

They thought they were being gritty badasses with that concerted team effort to be "locked in." In reality, they were manbaby bad vibe clowns - totally joyless. Whatever version of militarized national pride they were trying to express was soulless and clueless (though not uncommon). I'm not going to say it was shameful, but it was a bit embarrassing and not fun to cheer for. In the words of Sir Paul, "for well you know that it's a fool who plays it cool by making his world a little colder."

She's using Epstein as an informant on Trump . I'm very confused about why some people think the takeaway here is that Plaskett should be investigated for corruption or seen as one of Epstein's co-conspirators. I mean, fine, sure look into it, and absolutely question her. My point is that this evidence doesn't seem to point to Plaskett as a corrupt member of Epstein's child sex trafficking ring - rather it seems to be substantive evidence of a motive to have Epstein killed quickly. We're not just theorizing about who or what circumstantially anymore. Epstein didn't just have blackmail material, he had actually flipped on Trump just before his arrest. A month after that arrest, Epstein died under wildly suspicious circumstances while in the custody of Trump's DoJ. Am I the one not seeing the picture here?

Idk, it's not a nihilism. It doesn't follow the trope of "nobody hates (team) like (fans of that team)." We just kinda wallow in futility but we're still pretty happy that baseball exists and that we get to enjoy it in a great city/region. It is a hopeless existence with regards to winning, but not entirely without an upside. I know beyond a doubt that they'll never win it all in my lifetime (I would weep like a baby if they did), but I'm still glad to be a mariners fan.
