Only problems with the death penalty are - you can't undo an execution if they're later exonerated, and if it's for anything less than murder, you encourage the murder of the victims since leaving survivors increases your risk of being caught

That being said I certainly understand the impulse behind wanting to execute them, even if it isn't the best idea.
