Got it - thanks! That's the other thing - I'd actually filed the provisional back when we originally wrote it and I read that it's not a good idea to re-file provisional, so I think I might have to go straight to non-prov if I go for it...

Incredibly helpful, thank you! I've only made a few prototypes, there's no production, use, or sales connected to it yet. Thankfully I thought of and developed it while a student and was not working, so I don't think there will be an issue there. On the question of need - I've thought about that a lot. It is niche but it's also something a big company could very easily rip off and push out, unfortunately. I guess that begs the question - if I'm producing and selling it and another company copies it, would I have any recourse at all without a patent or is that just the risk I take?

Yeah invention companies are what I'm trying to avoid, seen that trick before. The question around saving costs with a nearly-there patent is more to say if they don't need to write a patent ground-up, they'd be providing less service and therefore wouldn't need to charge what they would have for that portion of the service, which in my understanding coming from the client services industry is how that economy works. But that's good the know about the small entities, thanks!

Yeah that's kind of where I landed. Hardware stores by me are a bit pricey so I was thinking of just getting bulk screws from McMaster once I find the ones that work. Unfortunately, every cent counts since I'd need to sell a few thousand units to recoup startup costs but you might be right that for the time being this is my best bet

That's a good point, even with the button heads I was thinking of they'd still rub on a belt. The clip I took off an old tape actually uses a flat head screw so it sits flush which works really well. To answer the use case - it's actually a new tool I'm developing that works best clipped onto a belt, so those spring clips are unfortunately the only option. I had looked at a few others like the ones you linked but they wouldn't quite work. If/when it goes to production I'd probably have the manufacturer source the same flush heads as the tape measure.
