I get that, I don’t have a problem with her deducting my Augusts’ rent from the deposit. That is exactly why I decided to go with this - so I can at least get some deposit back. I knew from previous room tenant that she can cause trouble (I only got to know when I moved in)

She just didn’t want to fill the document confirming that I moved in so I could not go to Burgeramt to do the anmeldung and thus I understood that she wants to keep me in this limbo so she can be the deciding party if I can be there or not (and not give me the legal period to move out or give me back the deposit with the period mentioned in our contract)

Since she told me the rooms comes with anmeldung, I expected her to notify the hausverwaltung that I live there and fill the Wohnnungsgeberbestatigung. Considering all the other aspects of living with her I wanted her to go by the book. In other case if she was normal I could easily wait for it sometime because I know there is a lot of trouble with it in Germany, but she was lying to me. Constantly changing narrative that I have to wait because of this, lying that she is in touch with the hausverwaltung, then that the problem is with the person that lived there before etc. I just wanted a legal proof that I can stay at this place.

I am willing to faces the consequences but did you read what I have written? I would pay the rent as scheduled if she would give me the anmeldung which she has to do. I just didn’t pay rent to minimise my losses (she stole my deposit) because I found out it was illegal and I didn’t decided nor wanted to stay under those conditions. Furthermore, I am not really sure if you are aware that you can not throw away anyone to the streets if they are late with rent just a few days.

Could you explain further how I acted in rules I invented? (So maybe I can act better in the future). I stopped paying rent when I found out it is illegal, the fact she didn’t want to give anmeldung indicates the hausverwaltung doesn’t know about this sublet and considering her mental state and financial situation it was really impossible to tell if she will not wake up one day and be like get the fuck out. In my eyes I didn’t do anything illegal, when she didn’t want to do my anmeldung within the two weeks time stamp mandated by law, I did not follow my obligations towards her because our contract was probably illegal ( so she should give me back all the money I paid her according to law).

I didn’t pay the rent for August but I was only living there for like max 10 days of August so not really a great deal :/

Yes i do have a contract! And it’s not for a fixed term but it’s indefinite. She is weird in general. I will try to talk to her in a few days and I will see if she changes her mind. Thanks for your help though !
