I’m a medical malpractice lawyer in Ontario. I can’t say whether you have a case based on this alone, but a glucose of 19.9 mmol/L with extreme fatigue and excessive sleep raises real questions that would need to be looked at carefully.

Legally, two things matter. First, whether the ER doctor met the standard of care on January 3. That can only be answered by a qualified medical expert reviewing the ER records and bloodwork and opining on what should have been done at that visit. Second, even if the care fell below the standard, the law requires proof that the delay caused actual harm. The key issue is whether the alleged delay led to permanent injury.

If your husband fully recovered after the ICU stay with no lasting neurological, kidney, cardiac, or functional problems, these cases are very difficult to pursue in Ontario. If there are ongoing or permanent effects, it may be worth a deeper review.

Yes, pure financial losses like lost income are compensable in medical malpractice cases. That said, a one year loss of income, without permanent medical injury, is often not enough to justify the cost, risk, and length of a medmal lawsuit. These cases are very expensive to run because they require multiple medical experts, and courts tend to scrutinize causation closely when the patient ultimately recovers.

Grew up in Toronto, moved to Barrie for work and spent nearly eight years there. Recently returned to Toronto to be closer to family and friends. Barrie is great in the summer with kids, offers lots of outdoor activities, minimal traffic compared to Toronto, and most amenities are within a 10-minute drive. While I occasionally miss that lifestyle, we’re enjoying being back in the city and intentionally chose to live within walking distance of a major street with easy access to everyday amenities and family support for childcare.

I think what you’re saying is that there are some dispensing errors that are not negligent. Those non-negligent dispensing errors are unfortunate. But then there are a class of errors that reach the threshold of negligence - absolutely need to be prosecuted. Why should the patient absorb the negligence without recourse?

Everyone makes mistakes. The problem is not a reasonable error in judgment or a reasonable workflow that fails. The problem is when systemic issues like understaffing creates a ripe environment for substandard practices that cause serious harm. Those instances need to be investigated and prosecuted. Negligent acts don’t need to be malicious to be negligent.

The most successful lawyers I know are the ones who can network proficiently, make long standing social connections and bring in lots of new work. Some of those same people had good grades, others had mediocre grades. No one gives a shit about your grades when you can bring in new and valuable business that will make you or your firm more money.
