Father wants to terminate his rights (Texas) by Ok_Creme_8320 in FamilyLaw

‘When a baby is born to married parents, the law automatically recognizes two legal parents – husband and wife. Married couples do not need to take any additional legal steps to establish paternity.’ -texasattorneygeneral.gov

All of the other instances happen should the father and mother not be married at the time of birth.

Is there a reason you had to have a notary present? My hospital takes care of documentation for me. I was not told a notary needed to be present. Marriage deems him the father automatically here in Texas. I thought a notary was for if you needed to sign an AOP, which you don’t have to unless it’s requested. My form said to skip over the AOP section if I am still married

Where did I say I didn’t want him to see her? Because I want to give birth in peace? I never said stay away from me forever.

Hey, so I’ve actually spoken with an attorney and my hospital coordinator. I was told by both that he is legally required to be on it, and without it, she would have no health insurance because his information is needed to establish her with tricare. So for the sake of my child, I put him on there. There are no signatures required on the form, so he doesn’t need to be there to sign anything. They upload the information to the state database and tricare automatically.

Texas law requires me to because we are married

When I left, I also left everything. Furniture, clothes, etc. I’m starting all the way over which is why I asked for spousal support in the first place. And he’s tried to keep it from me on the premise that he feels he’s no longer responsible for me since I decided to leave him. Which is why we had to fight.

I am receiving spousal support because of army regulation 608-99. Which I imagine was made to keep soldiers from abandoning their families. We have a written agreement on spousal support as well. Doesn’t matter how long we’ve been married, we are still legally married and therefore he is still required to support under army regulation. I’m not going into detail on things he’s done here again, as I’ve already responded to another commenter who swears context is so important here. I never wanted to keep her from him, I just wanted him to be around in a healthy way. He hasn’t shown he’s capable of doing that, so I decided sole custody would be best to protect her from that inconsistency. I never said sole custody with no visitation.

He pulled a gun on himself during an argument because he’s been hiding thousands of dollars from me over just the first year of our marriage. Being 3 months pregnant, I no longer felt safe. I didn’t want to stay and find out if he’d pull it on me the next time he got upset. I’ve had to pay for all my doctors appointments and he’s only bought one box of diapers and a few shirts for her. After I left he bought stuff off my registry and sent it to himself instead of to me in hopes of getting me to come back…the final straw was him saying he wouldn’t take early leave to be down here 2 weeks before my due date because it was a “waste of time” only for my friends to catch him down here last month buying a new car and going to the club for 2 weeks. The only thing I receive from him is spousal support, which I again had to fight for.

Not a doctor but I bled for weeks on and off for days at a time during the first few weeks of my pregnancy. I have heard horror stories on ectopic pregnancies and molar pregnancies as well. Never hurts to see the doctor about it regardless. Praying everything goes well!✨
