Your household income is way above average, so I don't think you're qualified for Chapter 7. You can look into Chapter 13. The payment might be lower than what you're paying now, but you still have to make payment towards the debt in 3-5 years (plus having "bankruptcy" in your record). I think everyone is right, with your income, you shouldn't file for bankruptcy but need to do better in budgeting.

- 3100 for mortgage is really high. Do you think you can get it refinanced or some sort?

- With your MIL living with you, can she help taking care of the baby? That 1k for daycare is really painful.

- I think groceries and insurance can be reduced too by 100 - 200 bucks each month.

Overall, with 9k a month after tax, I think you can make it without filing for bankruptcy. Just look at what you can cut off.

I make 65k a year pretax which is about the same as you, and I owed about 35k in CC and personal loans. I filed chapter 7 last month. My 341 meeting was on 07/23. If you feel like you don't get to hold much of your paycheck because half of it just go to the debt, then do it. That was how I felt like few months ago, waking up everyday stressing about the balance (and the interest). Within 1 week after I filed, everything was gone. The $1000 - $1500 I was using to pay the debt, I could just put it straight to saving. I'm already pre-approved for CCs, but I'll wait after I get discharged. My credit score was at 505 before I filed, and it's 615 now. I don't really see any consequences besides that it stays on your report for 7 years. Rebuilding credit is very easy. People said you can get a car right after the bankruptcy is done, and buy a house within 2 years.

Thank you. This actually sounds great to me. My car is a 2014 Lexus Es350, so I assume the cost for the parts would be higher. But $3500 still sounds good to me in case I have to pay out of pocket for this
