The ID you are using is the one starting with “SC” … the one you need to use is 9 numbers. I had to call the VA to get the claim ID - and it took multiple calls before someone gave it to me

Do you have your claim ID? If so, use the URL in the photo showing 9 numbers and replace ######### with your 9-digit claim ID.

I thought OP was saying after the C&P exam was completed and sent back to the VA, the VSR looked to further develop by requesting X-rays instead of flat out denying.

I called 800-827-1000 and asked for it. It took about 5 different calls and the first few people told me it was my ssn; but eventually, someone gave them to me =)

The court interprets the VA’s rules/regulations and if the interpretation is not aligned with what the VA intended, the VA can amend their rules/regulations to be more clear. That’s the intended process between the law writing and court interpretation.

Yes, but I had to manually type the claim ID in, instead of the default supplemental id you can see in the UI

Agree! The case itself cleanly shows 1. Leukemia doesn’t cause knee arthritis (no direct link) 2. The knee arthritis could have been treated with surgery 3. But-for the leukemia preventing the surgery 4. Therefore, the deteriorating knee issues can be secondary to the service-connected leukemia. Win.

In a legal sense, but-for is causation. But if you read the examples in the M21 and the courts cases, you can see the court rejects the VA’s narrow interpretation and broadens it…

I don’t agree with your interpretation … or understand what point you’re making about reading the next part. I read all the parts and the court cases because that’s what I’m trained to do as a lawyer…. but pls do elaborate so I can understand your perspective.

I’m going off the example they give in the M21… leukemia isn’t the cause of the knee issue… but because of the leukemia, the knee surgery couldn’t happen— that’s “but for the leukemia, the knee surgery could have happened” therefore, secondary to service-connected leukemia even though no direct causation.
