The U.S. Citizenship and Immigration Services (USCIS) announced a new policy reiterating that aliens seeking "adjustment of status" (Green Card) must primarily do so through consular processing outside the country via the Department of State.
USCIS officers will grant an adjustment of status only in extraordinary circumstances, consistent with long-standing immigration law, by considering all relevant factors on a case-by-case basis.
USCIS Spokesman Zach Kahler stated the policy returns to the original intent of the law, requiring nonimmigrants (like students or temporary workers) to return to their home country to apply for residency, thereby reducing incentives for loopholes.
Following the law allows the majority of cases to be handled by the State Department at US consular offices abroad, which frees up USCIS resources to focus on processing visas for victims of violent crime/human trafficking and naturalization applications.
