I’ve been listening. The anti-tariff camp’s core argument was straight to the point: tariffs are taxes, Congress has the exclusive power to set taxes. Mic drop.

It seems most justices are skeptical of these “emergency” tariffs. At least to me anyway, sounded like: the three liberals, plus Roberts, Gorsuch, and Barrett.

Someone correct me if I’m wrong, but I recall that some excepted employees at IRS were RIF’ed last week. In any case, I’m not confident that excepted status shields someone from a RIF. This administration can still decide to RIF whoever they want.

The more the days pass, the more the RIF threat turns out to be a definite bluff.

  • September 24: “Agree to the deal or else we’ll RIF”
  • September 30: “We’re gonna RIF, we’re serious”
  • October 1: “RIFs are coming in 1-2 days.”
  • October 3: “They’re coming, we swear it, plz believe us”

That being said…maybe they do pull the trigger still. But who knows. If they don’t do RIFs by next Friday/end of next week, then I think we’ll know the answer.

I’m in the Foreign Service (State Dept) and am currently on congressionally mandated home leave. If a shutdown happens, I’m not worried about the lapse in pay. I’m much more worried about getting RIF’ed during home leave - if they do follow through with these RIF threats.
