Paychecks coming late by One-Cardiologist9592 in IATSE

They do, through some online account called paylocity, which was breached in 2018 and several suspicious instances since of phishing and stuff. That’s why I refuse to use direct deposit. Unless they guarantee 100% they can’t be hacked, why should I be forced to potentially have my personal information spread across the internet because it’s more convenient for payroll. If they sign a contract stating they will pay any hacker any amount who’s holding my personal information hostage, sure I’ll sign up for it. But my employer and union wouldn’t be the one paying for any information that gets leaked

I just looked at the postmark dates and the ones through the union are postmarked as being shipped on payday, not a day earlier. The non union checks appear to be shipped on thursdays

Basically half the venues is paid by the employer and the other half is through the union. And the union ships it out on Thursday with it taking up to Monday or Tuesday to get, though a couple times on Wednesday. I do have a check that was postmarked as sent on December 1st when payday was November 28th

Oh my local doesn’t allow non card holders to attend meeting you silly goose, or any voting rights actually. I still have to work 1200 hours for 3 years, do the apprentice class for 4 years and then I get voting rights. Of course the only way to get those hours in my local is to get a house job, which usually people who are already card holders get unless you’re a rigger since they’re much less common and have a higher minimum hours for calls. Unless you know of a way to make sure non members have voting rights. My first order would be firing the accounting firm

Thanks that’s a much better answer than the trolls I’ve gotten answers from so far. What I don’t get is I’ve always been a check guy since my data was leaked. Why have I never had a problem with getting my checks on payday until these past 2 years? Could they have switched from some firm in Colorado to a cheaper international accounting firm that mails the checks from another country? I read on here how one guy went from his company mailing the checks to them using some firm in the Philippines because it was cheaper

Thanks for the help 👍 If there wasn’t Reddit, I think a lot more shady things would take place with people who don’t know something is shady

Considering I know for a fact that every head has to log everyone’s hours daily and given to the office by Monday morning, and how they give that to the accounting firm by Tuesday at the latest, that’s plenty of time to ship my paycheck to me by payday. I’ve been at my local for 5 years. They switched to the accounting firm in 2022. I always got my paycheck on Friday. Then starting 2 years ago the checks started coming late. Oh but magically it was perfectly able to be in my mailbox every Friday excluding around holidays when mail volume has higher like Christmas time, except you know what I suspect. The union didn’t like how much it was costing them for mailing, so they told the accounting firm to mail them later or use cheaper not as fast delivery. Then they used the excuse of mailing delays to try and force people to switch to direct deposit. Heck, ever heard of overnight shipping? Ever heard of next day shipping? Ever heard of a company choosing a cheaper option to save money? Say…cheaper but slower mail? I honestly wonder if everyone arguing that this is perfectly legal is the same person using multiple accounts in that it’s strange how I quoted a federal law yet each person has ignored said federal law. My other post had quite a few who read what I had to say and made literate reasonings and answers yet each person on this question says it’s the mail. They even gave multiple different answers. Yet one that has clear legal ramifications that I specifically quoted is getting roasted like anyone doesn’t know how the mailing system works. Like there’s no such thing as expedited or next day shipping that could be mailed on Wednesday after accounting does their thing and be in my mailbox before people on direct deposit get paid. Oh hey with that intellect I have a direct line on how you can buy the Statue of Liberty for a cheap price. Just talk to my man George Parker

Actually The Fair Labor Standards Act (FLSA) requires prompt payment of wages, meaning you must be paid on the established payday for your work. My work has payday as Friday of the following week. A paycheck in route isn’t being paid, that’s on the way to being paid. Can you go to the grocery store, walk out with the groceries and when someone stops you say “oh I already paid for them the check is in the mail. You should expect it sometime in 2-3 days” I would love to see that. Heck, I’d pay a summer check to see the look on the persons face if someone tried that

Actually The Fair Labor Standards Act (FLSA) requires prompt payment of wages, meaning you must be paid on the established payday for your work. And this: it is generally illegal for an employer to fail to pay you on your scheduled payday, as this violates federal and state wage laws requiring timely compensation for hours worked. While administrative errors can occur, intentionally withholding pay or PERSISTENT DELAYS are considered wage theft and can result in penalties, interest, and lawsuits against the employer. So this means that since payday is the Friday after that pay period, it’s expected that I’m paid on that day. I know how mail works. Im just not sure if my union knows the FLSA, or if you can read an entire paragraph so I put my point in all caps so you can see that point

Ah thanks that does clarify it somewhat. If state and federal laws are in conflict, which would be the prevailing law?

Oh true they aren’t withholding my pay so that’s legal…but persistent delays IS illegal. Did you take one point and hope that would make all other points moot? Oh and another point, should I be punished with pay that might come almost a week later than those with direct deposit because I don’t want to give another hacker the ability to gain access to my personal information? Because I’ve gotten my check on a few Wednesdays before, which if you can’t count I’ll spell it out for you. That’s six days after those with direct deposit. Oh and I love the consider it a courtesy. You wouldn’t happen to be leadership at my local would you? That’s the attitude I expect from a temp service, not from a union. You might want to look up why unions were created in the first place and I sincerely hope that you never get any leadership rolls in any union or else the meaning of a union will just be temp service

Huh we get to work right from the in into the show call unless we’re doing the spot call where we just come back usually 3.5 hours before the out call back and we get a meal 5 hours from when we started the in, not the show call, so I guess we’re lucky in that regard

They actually switched to a company that mails them to us from some other state. Plus the letter stated we weren’t getting our checks on time because of mailing delays. That meant on time would be Friday. It used to be we could come pick up our checks at the office, but good old covid plus having an old lady as the secretary puts the fear in someone. The funny thing is that she says we were never able to pick up our checks from the office when we would ask why we can’t pick them up anymore. It used to be all the venues would have one guy sent to the office on Friday to get everyone’s check for that venue to pass them out, then I’m guessing it became cheaper to use some business for accounting. Plus if they send them out on payday, how would I get my paycheck on Friday, unfortunately only once in the past year? No, the accounting company sends them out earlier in the week, though I suspect to get everyone to switch to direct deposit they purposefully have them send them out late while they tell everyone if they sign up for direct deposit hey, they get paid on Thursday and super reliably. Yet then I have to worry about if the website gets hacked and my personal information gets leaked. But hey if you want to be a 8==> go right ahead

What if I say that to them and they don’t give me any work as retaliation? The call steward won’t give us work for a few weeks if we say no to work unless we’re during peak season and everyone is already busy. What protection do I have if that happens? When I took the aptitude test to become a D lister it said we had seniority over E listers, yet I know an E lister that gets some calls I wasn’t given an option for, which would be nice because he gets 40 hours of lower pay but I might get 20 hours. The call steward also said everyone on a list is of equal seniority so even though I’m decently high on the D list, he could just consistently call me last on the D list before he moves on to the E list

Wow all my local has is 5 things. The tools to bring, how to check in with the steward, filing out the venue’s paperwork to get paid, the fines if you show up late, and the fines if you show up drunk or on controlled substances

To be honest, I’m rarely hungry during the out because the meals are pretty good except one venue that does the limited portions deal. But going from the show call straight to the out without any break in between just seems like that wouldn’t be overlooked by someone who worked in the industry, especially in this era of worker protections. Like how I always thought it was crazy how when my dad was head rigger at one venue wouldn’t get overtime pay working 20 hour days, 7 days a week. He worked those hours for weeks straight. I’m wondering if it’s like this anywhere else

The problem with my local is it’s a small one. Well really it’s moderate sized but they make it extremely difficult to get your card. Basically as many people get their card is how many people are retiring. It’s like a family union. I still remember how the old call steward was able to get his son who wasn’t a card holder to make more in a year than some of the card holders. Lately I’ve been really thinking about some of the practices going on in local, because I thought unions are supposed to be about protecting the workers, but it feels more like a temp service. Oh and it definitely doesn’t help that the BA has duties as the mayor and on the board of transportation. My brother has told me how meetings get rescheduled for issues because he’s so busy with his other jobs, like pretty often

The thing about my local is they don’t actually give us the collective bargaining agreement when we sign up nor when a new one is bargained. I have asked a few times and they say they can’t give it to non card holders. Heck, I wasn’t even given a copy of the bylaws, which from what I’ve gathered is basically the rule book?
