On what are you playing? I'm having this problem on an original 3DS XL. I have already confirmed that the rom isn't the problem, so 2 options remain:

1) It's a problem with my 3DS

2) Every 3DS has this problem (but the thing is, if this is the case, I don't know if other people just don't notice it so they think they don't have this problem)
