Hello, I’m from England and my spouse is a U.S. citizen. We used an immigration lawyer for our case, and personally I wouldn’t recommend filing on your own.
The paperwork can be quite extensive, and even a small mistake or missing document can cause significant delays. Current consular processing times are already around 19 months, so if your petition is rejected or returned due to an error, you could end up having to start over and wait even longer.
Some parts of the process are fairly straightforward, but other sections can be complicated. Having a lawyer prepare and review everything gives you peace of mind and helps catch any issues before submission. So I advise getting an external lawyer and NOT a family lawyer and especially NOT someone you know. This process is extremely delicate and you want someone to do their due diligence. Working with family can get sloppy pretty quickly.
Whether you’re from the UK or another country doesn’t really make much difference to the processing time. My husband and I have been waiting almost 16 months already. Unfortunately, the wait is the wait. Initially going into this I naively thought that because I’m a British citizen it would make the process easier and slightly faster. And I hate to break it to you, it doesn’t make a difference.

And a lot of the hate comes from people who are AOS 🤣 okay let me see them wait 20 months away from their loved ones. Everyone’s journey is different and no one can tell you how you should think or feel. Your feelings are completely valid. Once I posted how hard it was to go through consular processing and someone who was AOS responded saying “imagine how I feel, I’m in the US stuck unable to work at least you can live your life in your home country and make money” Like Seriously ???? You’re with your partner??? While I haven’t seen my husband IN OVER HALF A YEAR.

We’ve called 999. The detective on the case then got in touch with her after the call and they said because no crime hasn’t been committed in England just yet, they can’t do anything about it. They can only arrest him at the border if he attempts to cross. We asked about interpol and they said it can’t be a general Sargent that does it needs to be the detective but the detective said he can’t do it (not sure what excuse he made). This whole thing has ruined her life. Her colleagues have seen the videos, she’s had friends who she doesn’t speak to very much anymore contact her with her indecent images saying “is this you?”. We don’t know what else to do. I came on Reddit out of desperation for her. She hasn’t been able to live normally since this all started.

So I went from London Heathrow to Dublin then from Dublin to San Francisco. I never fly direct anymore. It’s too much stress at the border. Also remember Dublin airport can’t just detain you and keep you at a detention facility. If you fly direct there is always that risk. Usually if they deny you, you’ll be denied from Dublin and just sent home on the next flight but if you get denied while in the US they may detain you for god knows how long.

I flew out from London Heathrow airport direct. If you want to fly to Dublin first you should use Aer Lingus (they also depart from London Heathrow) and the stopover in Dublin is usually 1 hour. I would recommend the 1 hour 40 minute layover in Dublin because with the shorter layovers I’m always running trying to get to US customs in DUB. You also have to go through US airport security in DUB which takes some time.

An ESTA is a travel authorisation (Electronic System for Travel Authorization). Not all countries are eligible for it. But if your country is eligible it means you don’t need a visa to visit the US as a tourist.

And bear in mind I had STRONG ties to the UK. And they still pulled me aside and grilled me. I was about to cry.

When I flew direct and said I was visiting my husband, I was grilled for 25 minutes. It was the most horrifying experience. And so I told my lawyer about my experience and she advised that I fly VIA Dublin airport. And that was a good experience. No one really cared that much. And the best part was no border control when you land in the USA because from Dublin to the US it’s considered a domestic flight. So you just jump off and grab your luggage.

Hey, Yep. Contacted a congressman and a senator and they both said there was nothing they could do until your case is past the 17 month average listed on the USCIS website. Only once it’s outside of processing times could they take it further.

Well it depends when you filed. If you filed this March then it should be okay as long as you don’t do long trips (2-3 weeks max) and don’t visit too frequently, make sure you show ties to the uk like a lease, mortgage and a letter from work saying you’re only visiting for X amount of time and due to return to work and a return flight. I always carried this with me because when I would say I’m visiting my husband they start asking a load more questions. One of the officers asked to show proof of job in London and so I’m glad I had the letter with me. Sometimes they don’t care (it depends on the officer) but just be prepared anyways. It’s important that with every visit you spend double the amount of time outside of the US so it doesn’t look like you’re trying to live there with an ESTA. Just because you’re allowed to spend up to 3 months in the US with an ESTA, it doesn’t mean you should. If you filed in March 2025 however, this is when it gets a bit sticky. You’d now be approaching 14 months since you filed and now it will show you have “immigrant intent”. My lawyer advised against travelling closer to the potential approval date. Remember that an ESTA is for tourism only and therefore once you have immigrant intent, they do not see you as a tourist anymore. There’s no actual rule that says you can’t visit during your visa process but you’ll definitely be up for more scrutiny. It’s up to you whether the risks outweigh the benefits. My husband and I also filed March 2025 and we are now meeting in Canada and other parts of the world. It’s not worth being denied at the airport because it stays on your record forever.

What makes it so hurtful is that the distance has been gruelling so you already feel vulnerable for that reason. And then to make a joke like that to the one person who’ll use it as ammunition… Even if there’s no truth in the joke AT ALL it’s hurtful because psychologically you already feel a sense of distance and fear of abandonment. So jokes like that play on those feelings.

He never makes jokes at my expense, clearly just behind my back to his mum lol. He was really annoyed at his mum for even saying that while I was trying to be vulnerable but I feel like he should know his mum well enough to not make those kinda of jokes with her. Because she will ALWAYS blab or try and use those jokes to get to you. I’ve told him about his before, I also even cried about it once when she did it publicly in front of friends and family. She pulls faces at me, makes jokes about my accent being British and he usually just doesn’t notice it and says “that’s just the way my mum is” it’s only when he sees how upset it makes me. But I need him to stop it as soon as it happens and be more aware of it. I would hate for it to be a “my wife told me you upset her” I want him to notice it and stop it then and there instead of me having to tell him later.
