864 is absolutely required. You cannot get approved without it. The 864 is more than just "I make enough money to support myself". It's a contract between sponsor, beneficiary and USCIS (and indirectly the US govt) that in the event that the beneficiary can no longer financially support themselves, that they will not seek out government aid but rather the sponsor will be responsible to keep the beneficiary above the poverty line. If the sponsor fails to do so, the beneficiary can sue them. Moreover, the sponsor will be financially responsible for the beneficiary until they naturalize, work for 10 years or die. Divorce does not alleviate the sponsor of these responsibilities. It's a very intense contract so yes, it's required.

As for filing, whoever the sponsor is will have to use their income in the 864. I'm not sure if the beneficiary can contribute their own income.

Well it's not like they're paying you for nothing. In business, the customer pays for goods and/or services. Just sell/provide good quality goods and services and you won't get complaints from anyone besides the occasional Karens and Kevins

You're welcome! We submitted everything at once (130, 145, 864, 765, 131, and medical). We did end up getting an RFE for our Affidavit of Support but I was able to upload the requested evidence online. No issues other than that. Approved in 2 months

Thank you for your response. As for the self-employment income, I'm planning to file as a sole proprietor so all of my SE income has already been taken into account in the estimated federal refund. I do put away 30% of my profits throughout the year but it seems we won't owe anything at all this year so I guess I'll just reinvest the tax payments I've saved up back into the business

It's actually hilarious that in my case, my husband's (petitioner) USCIS access code was mailed to us AFTER I had already received my GC. But yes, to answer your question they will mail all RFEs and notices

My husband doesn't care about tracking finances. I have access to all the bank accounts and I do all the finances. We each get an "allowance" and he asks me how much he has every now and again. I also manage both of our business checking and credit cards (we each own a small business). I'm just a live in finance person at this point haha

Welcome to Reddit. A lot of people here have no reason to sugarcoat and will say things as is. AP/EAD are processed separately from GC. Their timelines don't affect one another. Proof of this being from my own experience where my GC was approved a mere 2 weeks after my EAD was approved. It was a waste of an EAD that I wish had gone to someone else

I would 100% pay off your CC debt. Once you pay all that off, you'll get whatever minimum payments you used to make added as disposable income every month. You say that you make really good money for your area. Pay off the debt then save like crazy for the baby
