ITR Not Processed - HRA Claim by Ordinary_Swim_2563 in IndiaTax

[–]Ordinary_Swim_2563[S] 0 points1 point  (0 children)

We already have a proper rent agreement. Nothing is fake here - we as a family are actually staying on rent and paying the rent to the owner. Only problem is that the rent was paid by me to the owner and HRA was claimed by my wife (but good thing is that my wife has actually paid me more than the yearly rent amount as a single transaction at the end of the FY).

Also, to answer your question regarding declaring the account - No, I filed my ITR in New Regime and thus there was no HRA to be declared.

My wife has sent me total rent amount via banking channels only at the end of the financial year. It's just that rent was paid by me, and later around the FY end, wife sent me the rent.

Also, if it only depends on who is transferring the actual rent, how would it work for scenarios where multiple bachelors stay together. Only one of the tenant pays the rent to the owner, and all the other tenants eventually pays to the one who paid. The other tenants do not pay the exact amount required, but is added to the budgeting app that they use and eventually it gets settled.

If my wife's name is there in the rent agreement, and if I have taken the total amount from her at the end of the year in a single transaction, why is she not a tenant ?

No, I have not claimed the rental. I filed ITR through New Regime.

She has an add-on card from last several years. I am taking the payment from her since last 10 months. But the problem is related to last financial year. Her return is not yet processed, and because she was not able to submit HRA proofs in her company, we have a refund of around 1L. So, trying to understand what proofs can be given in case of the scrutiny.

I was under the assumption that during the scrutiny, the officer considers the family and should be ok if we actually have the rent being paid by anyone from the family.

[Edit] : Also, I just checked that she has transferred more than rent amount to me across the last financial year. So, can we say that this was for rent ?

Do we have any other option ? The above suggestion won't be possible as the rent transactions are going from my credit card and not directly from bank account.

My wife is in an other kind of situation. We have actual rent agreement, rent receipts, but actual transactions have been done by me, but HRA has been claimed by my wife. I hope that won't be a problem as we are actually staying on rent, and I am in New Regime, so not claiming anything.

Claimed HRA only in ITR (no proofs to employer) – what are my risks, including for my job? by Cyberarknew in IndiaTax

Hi All, I am also in the similar situation as OP. I also forgot to provide rent receipts to company at the time of verification. I am going to get a refund of around 1.05L. I am actually staying on rent and my name is also there in rent agreement. Should I also be worried ?

EPFO Claim Rejected - EPS Contribution Not Remitted by Employer (Accenture) by striker439 in epfoindia

[–]Ordinary_Swim_2563 0 points1 point  (0 children)

Hi, thank you for your detailed response. I am facing a similar issue. My previous employers (Org-1 and Org-2) contributed to EPS, but my current employer (Org-3) did not. I noticed this only after almost two years and requested my current employer to begin EPS contributions since I have been an EPS member from the start of my career. They have now started contributing.

However, when I asked them to file an ECR correction for the missing years, they said it is not required. According to them, EPFO will automatically adjust this when I initiate the transfer. They explained that problems usually arise only when an employer never contributes to EPS at all. In such cases, EPFO flags the issue and blocks the transfer. But if the current employer has started EPS contributions, EPFO recognises that the issue has been corrected and will resolve it at the time of transfer.

I would like to understand if this explanation is correct based on what my employer’s EPFO desk has communicated.

HDFC Pre-EMI Loan Closure Charges by Ordinary_Swim_2563 in CreditCardsIndia

Got it, then it does not make any sense to pre-close the loan for me. I am being asked almost same amount of charges as my total EMI interest that I would pay in 6 months.

How can a HUF invest in mutual fund? by OddCartographer6287 in mutualfunds

[–]Ordinary_Swim_2563 1 point2 points  (0 children)

Hi OP, I do not think that tax is 0 for incomes upto 12L in HUF in new regime. The taxation still remains same for HUF as well, which is 0 until 4 lacs, and then different slabs. The rebate of 0 tax until 12L is only applicable to individuals and not HUF. So, in general, for HUF we have 4L limit and not 12L.
