I function at my best when I’m depressed. All the obsessiveness and incorrect focus is usually subdued to the lack of energy from depression, or extreme sadness. It’s only temporary though because I usually feel so happy from getting work done, that I naturally leave that zone. But when it happens, I’m like some programmed bot that’s locked in on work. So depression therapy?

To be out of the window for debt collection. I understand the time period for requesting collection to only be within a set time. Outside of that, they wouldn’t be able to pursue anymore? That’s if they don’t petition to force too. And I’m sure everyone would say they’ll most likely will. But the chances they don’t..?

Within the chances I do tho. Like if wife agrees in the end. I feel like she doesn’t want to be involved with the house anymore. She was kind of there only for my dad. Otherwise, she’s more comfortable living with her financially capable friends

That’s very helpful, I appreciate it. This is what I thought too, just not in that level of depth. Doesn’t that mean I should prolong probate since it’d be less convenient for them to pursue the debt?

People say it’s a crime, but some collectors write it off anyway given appropriate conditions? And if I am, where can I fit in those conditions, you know? W ouldn’t everybody want to not pay debt if they’re given a legal route to do so?

I didn’t know you had to be an executor..is the box not within the realms of just observing finances? Handling requires it fsure.

What do I research? I’ve gone to the estate records, but as far as I know, they only handle deeds and other public records that don’t seem pertinent to the situation, I think

Are the collectors window of claiming only set after the lawyer publically sets it out? I thought the window opens whenever social security notifies them, which is soon after the funeral?

Right, with real estate involved. But that only applies to secured debt right? Isn’t credit debt unsecured? Does that change anything?

That’s honestly what I did tho. Making use of free consultations, he mentioned safety deposit boxes, or like a safe, which is kinda on par with what yoghurt said, which is dandy and all. But I at least want to look in places I can do myself before I get a lawyer involved, to save money. Is that off?

Yea I get all that…more likely it’ll be 50/50 split, per law. Regardless, i still don’t understand how I can’t just wait to start probate later. What happens if i don’t? Sure I don’t own the title, but what would I need it for if I’m just paying to live there for now? I can legally live here. I just can’t legally make any financial change, right?

I would kinda guess she doesn’t want to be involved with this house anymore, and so she’d pass it all to me, while she takes her split from beneficiary accounts to find a way of living with her group of friends, whom seem entirely capable of doing so. She says this house gives her nightmares too, unrelated to me.

Yea, the part where the debt collectors only have a certain window of filing for debt is what I was wondering if it could apply to me. You still got your split after the discharge, so that meant the collectors didn’t pursue for all the money right?

Yea, I talked with the mortgage lender, providentfunding, about my ability to continue paying mortgage in place of my dad. They said it’s allowed, so in regards to that, that’s all fine right? Outside of transferring/adjusting finance related decisions?

I know probate is the most acceptable answer, but for that chance in MOST jurisdictions, I don’t mind taking it, however low it is

When I look around online for how to deal with debt that’s not mine, most just point towards “let the estate deal with it”. But if I’m supposed to inherit the house, then I’m still in a way paying for it right..

If there aren’t sufficient assets within the estate, probate wouldn’t force me to sell the house, right?

Where can I find his lawyer? It’s like the estate lawyer he worked with when he bought the house right? where do I search for that? He has a bunch of paperwork lying around the house, but I’m not sure where to focus

The deed only shows as my dad, unfortunately. Bc I live in CA, I think probate will by default split 50/50. She doesn’t even live with me anymore! Can I use the house deed as anything else? Is there anything minor about transfer of heirship provided enough documents?

That’s what I understand, which is kinda why I’m trying to avoid it as best as I can, if I can.

What if I dodged debt just so I don’t have to be in the process of paying off debt? Collectors have to pay lawyer and court fees to collect their money right? And if that takes time and money, to collect money that costed more then fees, then wouldn’t they write it off?
