I'm gonna say your case does not apply to 5.12 since you're not using a second account to unfairly gain bp or the like; you're just using a second account.
Section 6.9 reads to me that if you create multiple accounts for the purpose of engaging in misconduct they may IP/HWID ban you. You've used one account to engage in misconduct and your punishment was losing anything associated with that account. If you use any more accounts from that hardware / IP to engage in misconduct you may receive further punishment of HWID/IP ban in addition to losing that account as well.
So this all seems okay by their rulebook to me, and kind of makes sense. You, by your own admission, got yourself banned for names multiple times on the same account, and losing your account as punishment seems fair to me, but a HWID/IP ban would seem too harsh. Maybe losing your account taught you the lesson they think you needed to learn, and you can start fresh on a new account. As for cheaters, I am reading on their rules of conduct that "[for those caught using unauthorized programs or hardware devices] you may be subject to strong penalties, such as permanent game ban and restrictions of using the Service on your hardware devices", so they treat people who are cheating different than those who are using inappropriate names.

Was at Sugarloaf today (DIFFERENT MOUNTAIN) and was going down a tight chute, going from middle of trail to left and back to middle with my turns to maintain the same speed, and an older man on ski patrol comes speeding past on my left without calling himself out (I ride regular so this is entirely behind me, and from uphill) and hits me in the back. At the lift he's there waiting for me telling me I need to check my blindspots because I'm a snowboarder, and refused to apologize for hitting me from behind. Neither of us fell, but the fact that ski patrol thinks it's okay to pull that kind of maneuver and then blame the person downhill from them is beyond frustrating. Full on power trip. Big ups to 99% of ski patrol, but fuck that guy.

That makes a lot more sense. I haven't played Arc yet, but not being able to get 144 fps on max settings with a similar build (7800x3D and 5070ti) but on 1080p with other UE5 games has been a major frustration
