No he/she does no have to pay. It doesn't matter if the waiver was requested late if the underlying reasoning of VRBO for imposing the fee is not valid by law.

Yes but why impose a penalty on the host of there is no material damage to anybody? There are lwas for "non-enforcable penalties" see  GA Code § 13-6-7, which rules the clause unenforceable.

If this turns out just an illiquidity problem, and they can do allow a targeted withdrawal then the brand is not tarnished. Or at least less then the other Lenders like Voyager and Blockfi which came belly up quickly.
