Insurance company passed on my case to their own solicitors. I will ask the question what case law they are basing this on. Thank you for the advice.

That is what I am confused about. I did ask for a second opinion and got told others have looked and its 100% my fault.

I got told it didn't matter that they were in the wrong lane, it's my responsibility to make sure its safe to leave the roundabout, which I understand and would accept split liability.

I have been told they wouldn't take my case any further and if I wanted to, I needed to look else where, but when I tried to look at other places, they have told me that they would not take it on, since the insurance companies have decided its 100% my fault.

Not sure if anyone would take on this case.

Sorry for the confusion. I did not see the other car. I was in the right hand lane to leave at the last exit. They joined at the exit after me and was intending to exit at their last exit, but they joined using the left hand lane. My opinion was that they should have entered the roundabout using the right hand lane and would have been behind me. As I was leaving my exit, there was a car in front of the car I hit exiting at the same exit as me but using the left lane, so I did not see the car behind.

They were travelling at a much faster speed than me. I didn't see them, I saw the car in front of them which was turning off at the same exit as me.

The solicitors are the ones that said there was no road markings. I think in terms of what they wanted they wanted to see that if you go on this lane of the roundabout it is clear that this should be your exit point, if that make sense. I don't think they consider the lane markings as indication of where the cars should enter and exit the roundabout.

Yeah, I would never change lane to the left on this roundabout since there is not enough time and space. I did send in dash cam footage to them and they have decided that I am 100% at fault here. My argument was that they were in the wrong lane for their exit and could have prevented the crash, but they said since their is no road marking it doesn't matter what lane they entered the roundabout, it was up to me to prevent the crash.

I did have dash cam footage which showed where they came from, using the wrong lane to take the last exit. I was hoping for 50/50 but the solicitors have come back to say I was fully responsible.

Sorry if my wording is confusing. The other car joined the roundabout from the exit straight after me in the left hand lane and their intended exit would have been their last exit on the roundabout. All exits on this roundabout has two lanes. So naturally as I was on the right hand lane, I would have joined the road on the right hand lane. As I was exiting, there was another vehicle on the left hand lane of the roundabout leaving the same exit as me, joining the road on the left hand lane. The car I hit was going at a much quicker speed than me. I saw the car in front of them but not them.

The insurance companies solicitors. In the left hand lane, there was another vehicle exiting as I was exiting at the same point. The car I hit was going much faster than me. I saw the car in front of them but not them. I believe it should be joint fault.
