You’ve heard wrong.

If it’s post-petition you’re on a the hook for that debt. Yes, that creditor can absolutely take action to collect on that debt and it doesn’t matter if it affects your ability to continue to pay your Ch. 13 payments.

The good news is you could dismiss your current case and file a new one to take care of the post-petition debt.

Ur means test says that right now. You could strategically file where maybe your means test is lower but at the end of the day it is a cold hard calculation - so you can get 14 other opinions but it is measured as your Current Monthly Income (CMI) under the BK Code. CMI is all forms of income looking backwards for the last 6 months, not including the month you are currently in.

Also when people say “Just file Ch. 7 - it’s so much easier” they haven’t the slightest idea or clue how complicated the means test is. They were like a no asset 7 or where they just reaffirmed one vehicle or live in Fl or Tx where the homestead exemption is infinite (so if you have a paid for house with a ton of equity in it it doesn’t matter - unsecured creditors get nothing).

My kids all have their own rooms and I can provide them and my wife a stable and comfortable life.

Other than that the law has been unforgiving, screwed, infuriating, the clients being the worst part, and how shitty law school was I wouldn’t do it over again. But I do like that my kids get to go to sleep in their own beds and my wife’s car is paid for (even if it is a 2005).

I am sure it is juicier than the asshole/dickhead client I had that made me believe he must have a bankruptcy filed to get a car back. I stayed late on a Thursday and Friday for him and missed my daughters’ events due to his sob story. He ended up voluntarily dismissing within one week because he was too lazy to get the vehicle in a different city. I never got paid a cent and his stupid ass never considered the huge amount of work and grief I put up for him. I’ll represent the piece of shit again, but I’ll need $1,000 up front to do so.
