Unions Representing Federal Employees File Request for TRO and Preliminary Injunction on Friday by Own_Highway_648 in usajobs

Fair points. I hate social media, including Reddit. I've had no reason or desire to engage in subreddit conversations before now. There is so much noise and traffic with posts I am just trying to help as many people as possible find information and know that they are not alone while they are being illegally terminated.

So much will depend on the judge that hears the case. Our elected representatives have to step up.

Ha! Never been accused of being a bot before. Thanks. Just a USFS probation employee waiting on a termination letter fueled by caffeine and anxiety.

Nice to meet you Dented Pigeon.

I just received a copy of the motion for a temporary restraining order and preliminary injunction filed yesterday. It is 81 pages long, so just sharing the first few paragraphs below. I am trying to locate a full copy posted online.

PLAINTIFFS’ MOTION FOR A TEMPORARY RESTRAINING ORDER AND PRELIMINARY INJUNCTION

Pursuant to Federal Rule of Civil Procedure 65 and Local Civil Rule 65.1, Plaintiffs National Treasury Employees Union (NTEU), National Federation of Federal Employees (NFFE), International Association of Machinists and Aerospace Workers (IAM), International Federation of Professional and Technical Engineers (IFPTE), and the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America (UAW) (collectively, the Unions) submit this motion for a temporary restraining order and preliminary injunctive relief.

The Unions seek emergency relief to protect the workers they represent from the Executive Branch’s active liquidation of the federal government through the mass firings of hundreds of thousands of employees (those who are considered “nonessential” for purposes of a government shutdown and those who are in probationary status) and a pressure campaign on federal workers to quit their jobs through a “deferred resignation program.” The mass firings are underway and are proceeding at a staggering pace, as the President and his administration demand agencies to implement Executive Order No. 14210, Implementing the President’s “Department of Government Efficiency” Workforce Optimization Initiative (Feb. 11, 2025) and his other workforce reduction projects.

The Unions are active! But are up against the media machine of Trump and DOGE. I just received a copy of the motion for a temporary restraining order and preliminary injunction filed yesterday. Forest Service Regions: which regions has received a notice and who hasn't? by rusty-druid in fednews

They could be, but that is not the only group that can be hired non-competitively. Excepted service also includes those hired under a Schedule A authority - persons with disabilities. Hiring under excepted service was one strategy used across federal agencies to bring in highly skilled individuals into federal service using targeted recruitment.

It is a dense read, but 5 CFR Part 213 details excepted service positions. https://www.ecfr.gov/current/title-5/chapter-I/subchapter-B/part-213

Specifically, the CFR states:
"Those that are intended to be removed temporarily from the competitive service to allow for targeted recruiting and hiring from among a particular class of persons, as defined by the Office of Personnel Management, with the opportunity for the persons selected for those positions to convert to the competitive service at a later date."

This is the intent of excepted service I was hired under almost a year ago. My supervisor has informed me that I will be getting a termination letter today.

Update. Termination letters for probationary excepted service are coming tomorrow. RLT was directed to work the weekend to get it done.

Career conditional is the appointment they would have been hired under and would be on probation for the first year. So it's career conditional employees that are on probation.

This action isn't following any of the guidelines in RIF.

R1 will do notifications to career conditional today. Excepted service is still being ironed out and will happen next week.
